CITY OF EVERETT - CITYWIDE BICYCLE WAYFINDING <br />STATE FUND# HLP-PB21(014) <br />WO#3786 September 25, 2023 <br /> 41 <br /> 1 <br />Traffic control vehicles are excluded from the gross vehicle weight requirement. If 2 <br />placing construction signs will restrict traveled lanes, then the work will be permitted 3 <br />during the hours of allowable lane closures. 4 <br /> 5 <br />Advance Notification 6 <br />The Contractor shall notify the Engineer in writing of any traffic impacts related to 7 <br />lane closure, shoulder closure, sidewalk closure, or any combination for the week by 8 <br />12:00 p.m. (noon) Wednesday the week prior to the stated impacts. 9 <br /> 10 <br />The Contractor shall notify the Engineer in writing ten working days in advance of 11 <br />any traffic impacts related to full roadway closure, ramp closure, or both. 12 <br /> 13 <br />The Contractor shall notify the Engineer in writing of any changes to the stated traffic 14 <br />impacts a minimum of 48 hours prior to the traffic impacts. 15 <br /> 16 <br />1-07.24.RTF 17 <br />1-07.24 Rights of Way 18 <br />(July 23, 2015 APWA GSP) 19 <br /> 20 <br />Delete this section and replace it with the following: 21 <br /> 22 <br />Street Right of Way lines, limits of easements, and limits of construction permits are 23 <br />indicated in the Plans. The Contractor’s construction activities shall be confined within 24 <br />these limits, unless arrangements for use of private property are made. 25 <br /> 26 <br />Generally, the Contracting Agency will have obtained, prior to bid opening, all rights of way 27 <br />and easements, both permanent and temporary, necessary for carrying out the work. 28 <br />Exceptions to this are noted in the Bid Documents or will be brought to the Contractor’s 29 <br />attention by a duly issued Addendum. 30 <br /> 31 <br />Whenever any of the work is accomplished on or through property other than public Right 32 <br />of Way, the Contractor shall meet and fulfill all covenants and stipulations of any easement 33 <br />agreement obtained by the Contracting Agency from the owner of the private property. 34 <br />Copies of the easement agreements may be included in the Contract Provisions or made 35 <br />available to the Contractor as soon as practical after they have been obtained by the 36 <br />Engineer. 37 <br /> 38 <br />Whenever easements or rights of entry have not been acquired prior to advertising, these 39 <br />areas are so noted in the Plans. The Contractor shall not proceed with any portion of the 40 <br />work in areas where right of way, easements or rights of entry have not been acquired until 41 <br />the Engineer certifies to the Contractor that the right of way or easement is available or 42 <br />that the right of entry has been received. If the Contractor is delayed due to acts of 43 <br />omission on the part of the Contracting Agency in obtaining easements, rights of entry or 44 <br />right of way, the Contractor will be entitled to an extension of time. The Contractor agrees 45 <br />that such delay shall not be a breach of contract. 46 <br /> 47 <br />Each property owner shall be given 48 hours notice prior to entry by the Contractor. This 48 <br />includes entry onto easements and private property where private improvements must be 49 <br />adjusted. 50 <br /> 51
