If 2 placing construction signs will restrict traveled lanes, then the work will be permitted 3 during the hours of allowable lane closures. 4 5 Advance Notification 6 The Contractor shall notify the Engineer in writing of any traffic impacts related to 7 lane closure, shoulder closure, sidewalk closure, or any combination for the week by 8 12:00 p.m. (noon) Wednesday the week prior to the stated impacts. 9 10 The Contractor shall notify the Engineer in writing ten working days in advance of 11 any traffic impacts related to full roadway closure, ramp closure, or both. 12 13 The Contractor shall notify the Engineer in writing of any changes to the stated traffic 14 impacts a minimum of 48 hours prior to the traffic impacts. 15 16 1-07.24.RTF 17 1-07.24 Rights of Way 18 (July 23, 2015 APWA GSP) 19 20 Delete this section and replace it with the following: 21 22 Street Right of Way lines, limits of easements, and limits of construction permits are 23 indicated in the Plans. The Contractor’s construction activities shall be confined within 24 these limits, unless arrangements for use of private property are made. 25 26 Generally, the Contracting Agency will have obtained, prior to bid opening, all rights of way 27 and easements, both permanent and temporary, necessary for carrying out the work. 28 Exceptions to this are noted in the Bid Documents or will be brought to the Contractor’s 29 attention by a duly issued Addendum. 30 31 Whenever any of the work is accomplished on or through property other than public Right 32 of Way, the Contractor shall meet and fulfill all covenants and stipulations of any easement 33 agreement obtained by the Contracting Agency from the owner of the private property. 34 Copies of the easement agreements may be included in the Contract Provisions or made 35 available to the Contractor as soon as practical after they have been obtained by the 36 Engineer. 37 38 Whenever easements or rights of entry have not been acquired prior to advertising, these 39 areas are so noted in the Plans. The Contractor shall not proceed with any portion of the 40 work in areas where right of way, easements or rights of entry have not been acquired until 41 the Engineer certifies to the Contractor that the right of way or easement is available or 42 that the right of entry has been received. If the Contractor is delayed due to acts of 43 omission on the part of the Contracting Agency in obtaining easements, rights of entry or 44 right of way, the Contractor will be entitled to an extension of time. The Contractor agrees 45 that such delay shall not be a breach of contract. 46 47 Each property owner shall be given 48 hours notice prior to entry by the Contractor.
