water .from this source available for domestic and industrial wa- ter supply; and WHEREAS, It is necessary that certain parts of the land and other rights required for such improvement be condemned; and WHEREAS, such additional water supply to be provided by such improvement is necessary within the shortest possible time and for that reason the lands and other rights herein referred to must be acquired forthwith. Now, therefore, THE CITY OF EVERETT DOES ORDAIN: Section 1: That so much lands, water, water rights, ease- ments, rights-of-way, privileges, franchises and property neces- sary or convenient for the proper construction, control, main- * tenance and operation of the proposed additional water supply system of the City of Everett as proposed to the voters of said city by Ordinance No. 2433 of the city of Everett and ratified by such voters at a special election held in said city on the 4th day of May, 1929, and which system includes the construction of a diversion dam and intake on the Sultan River, in Township 29, North Range 8, L. W. M., also a pipe line and tunnel from said intake to Lake Chaplain, also a dam, spillway and control works for storage of water in Lake Chaplain, also a pipe line from Lake Chaplain to a connection with the existing water system of the City of Everett, also all necessary valves, blowoffs, tunnels, bridges and other structures and appurtenances neces- sary for the construction, control, maintenance and operation of said pipe line, also such improvements to the existing water system in Everett as are necessary to make the water from this source available for domestic and industrial water supply, be and the same are hereby condemned and appropriated to the pub- lic use for the purpose of supplying the City of Everett and the inhabitants thereof with an additional domestic and indus- trial water supply, said lands and other property and rights to be taken and appropriated only after just compensation has
