011) Section 4: Any such owner desiring to install and main- tain any such ornamental lighting system in the city of Everett shall file a written application with the City Clerk, addressed to the City Council of the City of Everett, which application shall be accompanied by a blue print and the plans and specifica- tions in detail of such system and shall state that such owner applies under and subject to all the terms and conditions of this ordinance and will at all times throughout the life of such per- mit, if granted, maintain such system in a condition for service and shall maintain nightly illumination thereon. All such plans and specifications shall be submitted to the City Electrician or City Engineer for his examination, and no such permit shall be granted for the erection of any system, the electrical plan for which is disapproved by him. Upon the return of the plans and specifications by the City Electrician or City Engineer to the City Council, the Council shall thereupon pass upon the same and if they find that such system will be in conformity with this ordinance and will not unduly obstruct traffic or endanger per- sons or property using said street, and will assist in the light- ing of such streets, avenues or public places, may grant a permit for the construction and maintenance thereof. Such permit shall nevertheless be granted upon the condition that such owner, his successozs or assigns shall at all times during the life of such permit , maintain such system in a safe manner and nightly illum- inate the same, failure so to do shall, without any action upon the part of the City of Everett, work an immediate forfeiture of such permit and upon the forfeiture of such permit the owner shall immediately remove the name and restore the street to as good condition as it was before the erection of such system, and in the event such original condition of said street has been im- proved, then to conform with the existing improvement.
