4. Decisions Within Thirty (30) Days: <br /> Final subdivisions or short subdivisions shall be approved, disapproved, or <br /> returned to the applicant within thirty (30) days from date of filing the final <br /> subdivision or short subdivision for approval by the Director and City Engineer <br /> or City Council, unless the applicant consents to an extension of such time <br /> period in writing. The thirty (30) day time period shall not commence to run <br /> until the applicant files with the City all required final subdivision or short <br /> subdivision documents completed to the satisfaction of the City. <br /> 5. File with Auditor: <br /> When the Director and City Engineer or City Council finds that the subdivision <br /> or short subdivision proposed for final approval has met all the conditions of <br /> final approval, the applicant shall give the original of said final subdivision or <br /> short subdivision for recording to the Snohomish County Auditor. The <br /> applicant will also furnish the City with one reproducible mylar copy. After this <br /> is done, the applicant must provide the City with proof of proper filing and <br /> recording before the subdivision or short subdivision becomes valid. <br /> 6. Valid Land Use For Subdivision: <br /> As required by Chapter 58.17.170, a subdivision shall be governed by the terms <br /> of the approval of the final plat, and any lots created thereunder shall be a valid <br /> land use not withstanding any change in zoning laws for a period of five (5) <br /> years from date of filing, unless the City Council finds that a change in <br /> conditions in the subdivision creates a serious threat to the public health or <br /> safety. <br /> 7. Resubdivision Restrictions for Short Subdivisions: <br /> a) Land within an approved short subdivision shall not be resubdivided for <br /> a period of five (5) years from the date of final approval of the short <br /> subdivision without the submission and approval of a final subdivision <br /> pursuant to all provisions of this Ordinance concerning the subdivision of <br /> land into ten or more lots, tracts or parcels. <br /> b) When the original short subdivision contains nine (9) or less lots, the <br /> above restrictions shall not apply to the creation of additional lots, not <br /> exceeding a total of nine (9). If the number exceeds nine (9), a new <br /> application must be filed and processed. After five (5) years, further <br /> division may be permitted when otherwise consistent with the regulations <br /> of the City. <br /> c) , Where there have been no dedications to the public and no sales of any <br /> lots in a short subdivision, nothing contained in this section shall prohibit <br /> an applicant from completely withdrawing his entire short subdivision <br /> application and thereafter presenting a new application. <br />
