c) The decision made by the Director and City Engineer shall be an <br /> administrative decision. Any appeals shall be in accordance with <br /> Ordinance No. 2136-96, as amended and Ordinance No. 2137-96, as <br /> amended. <br /> 5. Approval of the Preliminary Binding Site Plan by the City: <br /> Approval of the preliminary binding site plan shall constitute authorization for <br /> the applicant to develop the facilities and improvements as required in the <br /> approved preliminary binding site plan. Development shall be in accordance <br /> with the plans and specifications as approved by the City subject to all <br /> conditions and requirements of the preliminary approval imposed by the City. <br /> 6. Time Limits for Preliminary Approval: <br /> A preliminary binding site plan decision shall be issued by the City within one <br /> hundred twenty (120) days as defined in Ordinance No. 2136-96, as amended. <br /> 7. Expiration of Preliminary Binding Site Plan Approval: <br /> Final binding site plan approval must be obtained within three (3) years of <br /> preliminary binding site plan approval, after which time the preliminary binding <br /> site plan approval will be void. No extension may be granted by the City to the <br /> applicant. <br /> D. Review Process for Binding Site Plan with Previously Approved Site Plan <br /> 1. Required Review Process: <br /> An administrative binding site plan application with a previously approved site <br /> plan shall be reviewed as Review Process I, as defined in Ordinance No. 2136- <br /> 96, as amended. <br /> 2. Approval of Preliminary Binding Site Plan with a Previously Approved Site <br /> Plan shall consider the Land Division Evaluation Criteria and Development <br /> Standards in Section 7 of this Ordinance: <br /> The Director and City Engineer shall evaluate the proposed preliminary binding <br /> site plan application and its compliance with Section 7 of this Ordinance, all <br /> other applicable City Ordinances, and City Standards. <br /> 3. Decision by the City: <br /> a) If the Director and City Engineer find that the proposed binding site plan <br /> complies with Section 7 of this Ordinance, all other applicable City <br /> Ordinances, City Standards, and improvements required for the <br /> previously approved permit, the binding site plan shall be approved. If <br /> the Director and City Engineer find that the binding site plan is not in <br /> compliance with Section 7 of this Ordinance or other applicable City <br /> Ordinances, City Standards, and improvements required for the <br /> previously approved permit, the Director and City Engineer may <br /> 37 <br />
