b) If the conditions have been met, the City shall inscribe and execute its <br /> written approval on the face of the binding site plan map. If the City <br /> disapproves the binding site plan, it will be returned to the applicant with <br /> reasons for denial and conditions for compliance. <br /> 3. Approval Within Thirty (30) Days: <br /> Final binding site plan shall be approved, disapproved, or returned to the <br /> applicant within thirty (30) days from date of filing the final binding site plan <br /> for approval by the City, unless the applicant consents to an extension of such <br /> time period in writing. The thirty (30) day time period shall not commence to <br /> run until the applicant files with the City all required final binding site plan <br /> documents completed to the satisfaction of the City. <br /> 4. Residential Condominium Binding Site Plan Map: <br /> If a Residential Condominium Binding Site Plan map does not show all of the <br /> lots and the applicant proposes that the Binding Site Plan be developed in <br /> divisions, permission to develop in divisions will be granted by the City under <br /> the following conditions: <br /> a) The division of land is consistent with an approved site plan by the City. <br /> Such division can only take place with the filing of a declaration of <br /> condominium under the Horizontal Property Regimes Act, Chapter <br /> 65.32 RCW or the Condominium Act, Chapter 64.34 RCW; <br /> b) The proposed division is consistent with the approved phasing plan in <br /> which the phase is capable of receiving certification of occupancy or the <br /> total site has received certificate of occupancy by the City; and <br /> c) The proposed lot and the Binding Site Plan map meet the standards set <br /> forth in Section 5.E of this Ordinance and all new property corners are <br /> set or found to be consistent with the survey standards of this Ordinance. <br /> 5. Record with Auditor: <br /> When the City finds that the Binding Site Plan proposed for final approval <br /> meets all the conditions of final approval, then the applicant shall record the <br /> original of said Binding Site Plan and all approved divisions with the Snohomish <br /> County Auditor. The applicant will also furnish the City with one reproducible <br /> mylar copy, and the Snohomish County Assessor shall be furnished one paper <br /> copy. After this is done, the applicant must provide the City with proof of <br /> proper filing and recording before the Binding Site Plan becomes valid. <br /> 6. Development: <br /> All development must be in conformance with the recorded Binding Site Plan. <br /> 42 <br />
