CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 1 Div 1 – GENERAL REQMTS March 2024 <br />Work Order No. UP 3814 SP-54 <br />1-02.4(1)A Interpretation of Contract Documents <br />(******) <br />Should a Bidder find what is believed to be discrepancies in or omissions from the <br />Plans, Specifications, or Special Provisions, or should the Bidder be in doubt as to <br />their meaning, Bidder may submit to the Engineer a written request for an <br />interpretation thereof. The Bidder submitting the request will be responsible for its <br />prompt delivery. Any interpretation of the documents, if made, will be made only by <br />addendum duly issued and a copy of such addendum will be mailed or delivered <br />to each Bidder receiving a set of such documents. All requests for <br />interpretations must be received by the City or Engineer no later than 7 <br />calendar days prior to the Bid Opening Date. All questions regarding the <br />Contract Documents shall be referred to the City or Engineer at the address <br />provided in the Contract Documents. <br />1-02.4(1)B Prevailing Wages <br />(******) <br />Bidder is directed to 1-07.9(1) of these Special Provisions for requirements <br />regarding applying payment of prevailing wage rates for employment of labor on <br />within Snohomish County. <br />1-02.4(2) Subsurface Information <br />Delete the first paragraph and substitute the following: <br />If the City has made subsurface investigation of the site of the proposed Work, the <br />boring log data and soil sample test data accumulated by the City will be made <br />available for inspection by the Bidders. The boring logs and soil sample test data <br />shall NOT be considered as part of the Contract, regardless of whether such data <br />is supplied as an Appendix to the Special Provisions or not. In addition, the City <br />makes no representation or warranty expressed or implied that: <br />1. The Bidders’ interpretations from the boring logs are correct, <br />2. Moisture conditions and indicated water tables will not vary from those <br />found at the time the borings were made, and <br />3. The ground at the location of the borings has not been physically <br />disturbed or altered after the boring was made. <br />The City specifically makes no representations, guarantees, or warranties as to <br />the condition, materials, or proportions of the materials between the specific <br />borings regardless of any subsurface information the Contracting Agency may <br />make available to the prospective Bidders. <br />Supplement 1-02.4(2) by adding the following: <br />The boring log data and soil sample data, if any, can be found in Appendix _. <br />If there is a geotechnical report made by the City, Bidder may contact City of <br />Everett Project Manager to arrange to view the geotechnical report. <br />The availability of subsurface information from the City shall not relieve the Bidder <br />or the Contractor from risks or of their duty to make examinations and <br />investigations as required by Section 1-02.4(1) or other responsibility under the <br />Contract or as may be required by law. <br />1-02.5 Proposal Form <br />Delete this section and substitute the following: <br />The Proposal Form identifies the project and its location and describes the Work. It <br />also lists estimated quantities, units of measurement, the items of work, and the <br />materials to be furnished at the unit bid prices. Bidder shall complete spaces on the <br />proposal form that call for, and are not limited to, unit prices; extensions; summations; <br />the total bid amount; signatures; date; and, where applicable, retail sales taxes and
