CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 1 Div 1 – GENERAL REQMTS March 2024 <br />Work Order No. UP 3814 SP-55 <br />acknowledgment of addenda; bidder’s name, address, bidder’s email address, <br />telephone number, and signature; bidder’s UDBE/DBE/M/WBE commitment, if <br />applicable; a State of Washington Contractor’s Registration Number; and a Business <br />License Number, if applicable. Bids shall be completed by typing or shall be printed in <br />ink by hand, preferably in black ink. The required certifications are included as part of <br />the Proposal Form. <br />Bidder shall submit Bidder’s Proposal on the Proposal Form provided in the Contract <br />Documents. <br />The City reserves the right to arrange the proposal forms with alternates and additives, <br />if such be to the advantage of the City. Bidder shall bid on all alternates and additives <br />set forth in the Proposal Form unless otherwise specified. <br />1-02.6 Preparation of Proposal <br />Delete “unless it approves in writing” from the second sentence of the first paragraph of 1- <br />02.6. <br />Revise the fourth paragraph of 1-02.6, beginning with “The Bidder shall submit with the Bid <br />a completed Disadvantaged Business Enterprise (DBE) Utilization Certification”, to read as <br />follows: <br />Contractor agrees that the Contractor shall actively solicit the employment of minority <br />group members. Contractor further agrees that the Contractor shall actively solicit Bids <br />for the subcontracting of goods or services from qualified minority businesses. <br />Contractor shall furnish evidence of the Contractor's compliance with these <br />requirements of minority employment and solicitation. Contractor further agrees to <br />consider the grant of subcontracts to said minority bidders on the basis of substantially <br />equal proposals in the light most favorable to said minority businesses. The Contractor <br />shall be required to submit evidence of compliance with this section as part of the Bid <br />by submitting the RCW 35.22.650 Certification. <br />Delete the sixth paragraph of 1-02.6, which begins with “The Bidder shall submit with their <br />Bid a completed Contractor Certification Wage Law Compliance form (WSDOT Form 272- <br />009).” <br />Supplement 1-02.6 by adding the following: <br />In the event that the product of a unit price and an estimated quantity does not equal <br />the extended amount quoted, the unit price shall govern, and the correct product of the <br />unit price and the estimated quantity shall be deemed to be the amount bid. If the sum <br />of two or more items in a bidding schedule does not equal the total amounts quoted, <br />the individual item amounts shall govern and the correct total shall be deemed to be <br />the amount bid. Do not qualify Proposal, since this will automatically be cause for <br />rejection of the Proposal. <br />Bidders are warned against making erasures or alterations of any kind to the Proposal <br />Form, and proposals that contain omissions, erasures, or irregularities of any kind may <br />be rejected. No oral, electronic, fax, telegraphic, or telephonic proposals or <br />modifications will be considered. <br />1-02.7 Bid Deposit <br />Supplement 1-02.7 by adding the following: <br />Bid deposit shall serve as evidence of good faith and as a guarantee that if awarded <br />the Contract the Bidder will execute the Contract and provide bonds as required by the <br />Bid. Should the successful Bidder fail to enter into the Contract, furnish a satisfactory <br />performance and payment bond, and furnish evidence of insurance within 14 calendar <br />days after the Award Date, the certified check, cashier’s check or bid bond shall, <br />unless otherwise provided in the Contract Documents, be forfeited as liquidated <br />damages.
