Edgewater Creek Bridge Replacement November 2023 74 Advance Notification 1 The Contractor shall notify the Engineer in writing of any traffic impacts related to 2 lane closure, shoulder closure, sidewalk closure, or any combination for the week by 3 12:00 p.m. (noon) Wednesday the week prior to the stated impacts. 4 5 The Contractor shall notify the Engineer in writing ten working days in advance of 6 any traffic impacts related to full roadway closure, ramp closure, or both. 7 8 The Contractor shall notify the Engineer in writing of any changes to the stated traffic 9 impacts a minimum of 48 hours prior to the traffic impacts. 10 11 1-07.24.RTF 12 1-07.24 Rights of Way 13 (July 23, 2015 APWA GSP) 14 15 Delete this section and replace it with the following: 16 17 Street Right of Way lines, limits of easements, and limits of construction permits are 18 indicated in the Plans. The Contractor’s construction activities shall be confined within 19 these limits, unless arrangements for use of private property are made. 20 21 Generally, the Contracting Agency will have obtained, prior to bid opening, all rights of 22 way and easements, both permanent and temporary, necessary for carrying out the 23 work. Exceptions to this are noted in the Bid Documents or will be brought to the 24 Contractor’s attention by a duly issued Addendum. 25 26 Whenever any of the work is accomplished on or through property other than public 27 Right of Way, the Contractor shall meet and fulfill all covenants and stipulations of any 28 easement agreement obtained by the Contracting Agency from the owner of the private 29 property. Copies of the easement agreements may be included in the Contract 30 Provisions or made available to the Contractor as soon as practical after they have been 31 obtained by the Engineer. 32 33 Whenever easements or rights of entry have not been acquired prior to advertising, 34 these areas are so noted in the Plans. The Contractor shall not proceed with any portion 35 of the work in areas where right of way, easements or rights of entry have not been 36 acquired until the Engineer certifies to the Contractor that the right of way or easement is 37 available or that the right of entry has been received. If the Contractor is delayed due to 38 acts of omission on the part of the Contracting Agency in obtaining easements, rights of 39 entry or right of way, the Contractor will be entitled to an extension of time. The 40 Contractor agrees that such delay shall not be a breach of contract. 41 42 Each property owner shall be given 48 hours notice prior to entry by the Contractor. This 43 includes entry onto easements and private property where private improvements must 44 be adjusted. 45 46 The Contractor shall be responsible for providing, without expense or liability to the 47 Contracting Agency, any additional land and access thereto that the Contractor may 48 desire for temporary construction facilities, storage of materials, or other Contractor 49 needs. However, before using any private property, whether adjoining the work or not, 50 the Contractor shall file with the Engineer a written permission of the private property 51 owner, and, upon vacating the premises, a written release from the property owner of 52
