1-02.10 Withdrawing, Revising, or Supplementing Bid <br />After submitting a physical Bid Form to the City, the Bidder may withdraw, revise, or supplement <br />it if: <br />1. The Bidder submits a written request signed by an authorized person and <br />physically delivers it to the place designated for receipt of Bids, and <br />2. The City receives the request before the time set for receipt of Bids, and <br />3. The revised or supplemented Bid (if any) is received by the City before the time set <br />for receipt of the Bid. <br />The original physical Bid Form may be supplemented, or revised and resubmitted as the official <br />Bid if the City receives it before the time set for receipt of Bids. <br />Email, fax or telephone requests to withdraw, revise, or supplement a Bid are not acceptable. <br />Resubmitted Bids shall be in full compliance with the bidding requirements. Bid deposit shall be <br />in an amount sufficient for the Bid as resubmitted. <br />After the scheduled time for opening Bids, no Bidder will be permitted to withdraw its Bid unless <br />the award of contract is delayed for a period exceeding 60 calendar days. Proposals received <br />after the scheduled closing for opening Proposals will be returned unopened to the Bidder. <br />1-02.11 Not Used <br />1-02.12 Public Opening of Proposals <br />1-02.12(1) Postponement of Opening <br />Proposals will be opened and publicly read at the time indicated in the call for Bids unless the <br />Bid opening has been delayed or canceled. Bidders, their authorized agents, and other <br />interested parties are invited to be present. <br />If an emergency or unanticipated event interrupts normal work processes of the City so that <br />Bids cannot be opened at the time indicated in the call for Bids the time specified for opening of <br />Bids will be deemed to be extended to the same time of day on the first work day on which the <br />normal work processes of the City resume. <br />The City reserves the right to postpone the date and time for receiving or opening of Bids, or <br />both, at any time prior to the date and time established in the Notice to Bidders. Postponement <br />notices shall be provided to Bidders in the form of addenda. <br />1-02.12(2) Video Conferencing <br />The City reserves the right to open and publicly read Bids by use of video-conferencing, such <br />as by Microsoft Teams, Zoom or other application. <br />1-02.13 Irregular Bids <br />1. A Proposal will be considered irregular and will be rejected if: <br />a. The authorized bid form furnished by the City is not used or is altered; <br />b. The completed bid form contains any unauthorized additions, deletions, alternate <br />Bids, or conditions; <br />c. The Bidder adds provisions reserving the right to reject or accept the Award, or <br />enter into the Contract; <br />d. A price per unit cannot be determined from the Bid Form; <br />e. The Bid Form is not properly executed; <br />f. The Bidder fails to submit or properly complete on the form provided by the City a <br />Subcontractor list, if applicable, as required in these Instructions; <br />The Bidder fails to submit or properly complete a RCW 35.22.650 Certification, as <br />required in these Instructions; <br />h. The Bidder fails to submit or properly complete a Non -collusion Affidavit, as <br />required in these Instructions; <br />i. The Bid Form does not constitute a definite and unqualified offer to meet the <br />material terms of the Bid invitation; or <br />More than one proposal is submitted for the same project from a Bidder under the <br />same or different names. <br />g. <br />j. <br />Reservoir 3 Replacement Phase 1 <br />Work Order No. UP3739 00 21 13 <br />INSTRUCTIONS TO BIDDERS March 2024 <br />
