Fabrication of an item shall be commenced only after the City has reviewed the <br />pertinent submittals and returned copies to the Contractor marked either “NO <br />EXCEPTIONS TAKEN”, “REVIEWED FOR INFORMATION ONLY” or “MAKE <br />CORRECTIONS NOTED.” Corrections indicated on submittals shall be <br />considered as changes necessary to meet the requirements of the Contract <br />Documents and shall not be taken as the basis for changes to the contract <br />requirements. <br />K. All Contractor shop drawing submittals shall be carefully reviewed by an <br />authorized representative of the Contractor, prior to submission to the City. Each <br />submittal shall be dated, signed, and certified by the Contractor, as being correct <br />and in strict conformance with the Contract Documents. In the case of shop <br />drawings, each sheet shall be so dated, signed, and certified. No consideration <br />for review by the City of any Contractor submittals will be made for any items <br />which have not been so certified by the Contractor. All non-certified submittals <br />will be returned to the Contractor without action taken by the City, and any delays <br />caused thereby shall be the total responsibility of the Contractor. <br />L. The City's review of Contractor shop drawings submittals shall not relieve the <br />Contractor of the entire responsibility for the correctness of details and <br />dimensions. The Contractor shall assume all responsibility and risk for any misfits <br />due to any errors in Contractor submittals. The Contractor shall be responsible <br />for the dimensions and the design of adequate connections and details. <br />M. The Contractor’s Submittals and Shop Drawings shall not be used to submit <br />substitutions of materials or methods required by the Contract. Instead, all <br />requests for substitutions shall be made as a separate request. <br />N. This review is only for general conformance with the design concept of the <br />project and the information given in the Contract Documents. Corrections or <br />comments made on the project data submittals and shop drawings during this <br />review do not relieve the Contractor from his/her obligation to perform fully all <br />contract requirements. Contractor is not entitled to rely upon the corrections or <br />comments made on the project data submittals and shop drawings during this <br />review. The review by the Engineer of project data and shop drawings is only for <br />conformance with the general design concept of the project, and does not extend <br />to consideration of specific dimensions, structural integrity, safety, detailed <br />installation and construction requirements, or any other obligation of the <br />Contractor. Review of a specific item shall not include review of an assembly of <br />which the item is a component. The review by the Engineer is for the benefit of <br />the Owner only. Any action shown is subject to the requirements of the Contract <br />Documents. Neither the review of the Contractor’s submittal nor the corrections <br />or comments provided herein, shall create any duty owed to or a cause of action <br />in favor of the Contractor or any Subcontractor. Contractor is responsible for: <br />dimensions which shall be confirmed and correlated at the job site; information <br />that pertains solely to the fabrication processes or to means, methods, <br />techniques sequences and procedures of construction, coordination of the Work <br />with that of all other trades and performing all Work in a safe and satisfactory <br />manner.
