Section 00 72 00 GENERAL CONDITIONS <br /> <br />City of Everett 00 72 00-8 June 2024 <br />WFP Air Scour Blower Building Replacement Issued for Bid <br />UP3813 <br />make its own investigations, including exploratory excavations, to determine the locations and <br />type of existing utilities, including service connections, prior to commencing work that could <br />result in damage to such utilities. The Contractor shall immediately notify the Owner’s <br />Representative as to any utility discovered by him in a different position than shown on the <br />Drawings or which is not shown on the Drawings. No excavation shall begin until all known <br />facilities in the excavation areas have been marked. Contractor shall coordinate its activities <br />with the utility provider. Contractor shall bear the cost of maintaining utility service. <br />The Contractor should be aware of, and comply with, Chapter 19.122 RCW, a law relating to <br />underground utilities. The Owner shall not pay Contractor any of Contractor’s cost of complying <br />with this law, or repairing or indemnifying any damage or injury arising out of Contractor’s failure <br />to comply with this law. <br />Owner does not represent or warrant who may be obligated to pay for the cost of relocation or <br />temporary maintenance of the utility. Contractor shall investigate whether such cost must be <br />borne by the owner of the utility. <br />Governmental agencies and owners of utilities reserve the right to enter upon streets, alleys, <br />rights-of-way, or easements for the purpose of making changes in their property made <br />necessary by the Work and for the purpose of maintaining and making repairs to their property. <br />2.3.3.2 Known Utilities <br />The Contractor shall provide at its sole expense all labor, equipment, materials and services <br />necessary to remove, relocate, or maintain utilities specified on the Drawings. The work on each <br />utility shall be performed in a manner satisfactory to the utility owner. The utility owner has the <br />option of doing such work with its own forces at the Contractor's expense, or permitting the work <br />to be performed by the Contractor. <br />2.3.3.3 Service Connections <br />Locations of service connections are not identified on the Drawings. The Contractor shall <br />provide at its sole expense all labor, equipment and material to remove, relocate or maintain <br />service connections. Work on service connections shall be performed in a manner satisfactory <br />to the service connection owner. The service connection owner has the option of doing such <br />work with its own force at the Contractor's expense, or permitting the work to be performed by <br />the Contractor. <br />2.3.3.4 Unknown Utilities <br />When a utility interferes with the Work and is either (1) not identified on the Drawings or (2) <br />located in a position significantly different from that specified on the Drawings, Contractor shall <br />follow the procedures of ARTICLE 11. DIFFERING SITE CONDITIONS. Interference with the <br />Work is defined as a utility that crosses or projects into the plane of the Work at an elevation <br />between the top and bottom of the Work. If it is necessary to remove, relocate, or temporarily <br />maintain the utility, that work shall be included in a Change Order. The utility owner has the <br />option of doing such work or permitting the work to be performed by the Contractor. In either <br />case, the cost of the work incurred by or charged to the Contractor will be included in a Change <br />Order. <br />2.4. SUBMITTALS <br />Where required by the Contract Documents, the Contractor shall submit information which will <br />enable the Owner’s Representative to advise the Owner whether the Contractor's proposed <br />materials, Equipment or methods of work are in general conformance to the design concept and <br />in compliance with the Drawings and Specifications, such as catalog cuts and shop, working or <br />detail drawings. In its Submittals, the Contractor shall expressly and explicitly notify the Owner’s <br />Representative of any and all deviations from the Specifications. Without express and explicit <br />Notice of a deviation from the Contract requirements, approval of a Submittal does not relieve
