EVERETT <br /> LEASE AMENDMENT NO. 4 <br /> This Lease Amendment No. 4 (this "Amendment") is entered into as of the date of last <br /> signature below between Everett Physical Therapy and Sports Performance Center PLLC, a <br /> Washington professional limited liability company ("Tenant" or "Lessee"), and City of Everett, a <br /> Washington municipal corporation ("Landlord"or"Lessor"),for premises located at 2000 Hewitt <br /> Avenue, Suite 115, Everett, WA 98201 ("Premises"). <br /> RECITALS <br /> A. Landlord and Tenant are parties to the Conference Center Building Lease dated on or <br /> about October 15, 2003,as amended by Lease Amendment No. 1 dated May 10,2011; <br /> Lease Amendment No. 2 dated October 14, 2013; and Lease Amendment No. 3 dated <br /> February 7,2019(as amended,the"Lease"). Capitalized terms used,but not defined, <br /> in this Amendment have the meanings given in the Lease. <br /> B. The parties have agreed to extend the term of the Lease for the period January 1, <br /> 2024 to March 31, 2029. <br /> C. The parties now wish to amend the Lease to confirm their agreements regarding rent <br /> during the extension term and other matters. <br /> AMENDMENTS <br /> Landlord and Tenant hereby incorporate the recitals and agree as follows: <br /> 1. Extension of Lease. The parties extend the Lease until March 31, 2029. <br /> 2. Monthly Rent for January to March 2024. The parties agree that monthly rent <br /> (including leasehold excise tax) for January 2024, February 2024, and March 2024 will be <br /> $10,212.02 per month. This amount is $8,700 base rent plus $350 parking base rent (five stalls) <br /> plus $1,162.02 leasehold excise tax. <br /> 3. Monthly Rent for April 1, 2024 to March 31, 2029. <br /> A. Each time period from April 1 to March 31 is referred to in this Amendment <br /> as an "Extension Lease Year." The Extension Lease Years under this Amendment are: April 1, <br /> 2024 to March 31, 2025;April 1, 2025 to March 31, 2026; April 1, 2026 to March 31, 2027; April <br /> 1, 2027 to March 31, 2028; and April 1, 2028 to March 31, 2029. <br />
