B. On April 1, 2024 and each April 1 thereafter, monthly base rent will <br /> increase for the upcoming Extension Lease Year by the percentage increase of the previous year <br /> (December to December) in the Consumer Price Index for All Urban Consumers in the Seattle- <br /> Everett Area or successor index. <br /> The percentage index increase for December 2022 to December 2023 is now known <br /> to be 4.4%. This means monthly rent (including leasehold excise tax) for the first <br /> Extension Lease Year (April 1, 2024 to March 31, 2025) will be $10,661.35. This <br /> amount is the sum of$9,082.80 base rent plus $365.40 parking base rent (five stalls) <br /> plus $1,213.15 leasehold excise tax. Rent for subsequent Extension Lease Years will <br /> be calculated in the same way. <br /> C. Regardless of the foregoing, monthly base rent will not increase by more <br /> than eight percent (8%) per Extension Lease Year or increase by less than three percent (3%) per <br /> Extension Lease Year. <br /> 4. Closure Regarding Previous Extension Term. The parties agree that the <br /> negotiation of this Amendment No. 4 has taken into account all payments and improvement <br /> obligations under the Lease related to the previous extension term (January 1, 2019 to December <br /> 31, 2023), with the parties desiring to begin the new extension term with a "clean slate." <br /> Accordingly, the parties agree that, as of January 1, 2024, all matters relating to the previous <br /> extension term regarding improvements to the Leased Premises or regarding rent or leasehold <br /> excise tax are now fully released and closed, with Landord and Tenant not owing each other any <br /> payment or refund for those items. <br /> 5. Capital Improvements. The Parties herein agree to share equally in the cost to <br /> replace flooring in the Premises. Tenant shall receive a one-time rent credit in an amount which <br /> represents 50% of the flooring replacement cost, with the rent credit not to exceed $12,000.00. <br /> This work will be completed by Tenant. Tenant and each contractor and subcontractor engaged <br /> in this work shall pay all workers, laborers, or mechanics employed in the performance of any <br /> part of the work an amount not less than the prevailing rate of wages established for each trade <br /> or occupation as established by the Washington Department of Labor and Industries, in <br /> accordance with Chapter 39.12 RCW(Prevailing Wages). The rent credit will be applied after the <br /> completion of the work with all such wages paid. <br /> 6. Full Force and Effect; No Other Modifications. Except as expressly amended in this <br /> Amendment, the terms and conditions of the Lease remain in full force and effect without <br /> modification. From and after the Effective Date, all references to the "Lease" or "this Lease" in <br /> the Lease are deemed references to the Lease as modified by this Amendment. <br /> [signature pages follow] <br /> 2 <br />
