CITY OF EVERETT WEST MARINE VIEW DRIVE/ALVERSON AND 41 ST ST/GRAND AVE <br />PEDESTRIAN IMPROVEMENTS <br />STATE FUND# HLP-PB15(032) <br />WO #3630 July 25, 2024 <br />18 <br />1 machinery or other mechanical equipment; street lighting, electrical distribution or signal <br />2 systems; irrigation systems; buildings; or other similar work it may be desirable for the <br />3 Engineer to have the Contractor operate and test the work for a period of time after final <br />4 inspection but prior to the physical completion date. Whenever items of work are listed in <br />5 the Contract Provisions for operational testing they shall be fully tested under operating <br />6 conditions for the time period specified to ensure their acceptability prior to the Physical <br />7 Completion Date. During and following the test period, the Contractor shall correct any <br />8 items of workmanship, materials, or equipment which prove faulty, or that are not in first <br />9 class operating condition. Equipment, electrical controls, meters, or other devices and <br />10 equipment to be tested during this period shall be tested under the observation of the <br />11 Engineer, so that the Engineer may determine their suitability for the purpose for which <br />12 they were installed. The Physical Completion Date cannot be established until testing and <br />13 corrections have been completed to the satisfaction of the Engineer. <br />14 <br />15 The costs for power, gas, labor, material, supplies, and everything else needed to <br />16 successfully complete operational testing, shall be included in the unit contract prices <br />17 related to the system being tested, unless specifically set forth otherwise in the proposal. <br />18 <br />19 Operational and test periods, when required by the Engineer, shall not affect a <br />20 manufacturers guaranties or warranties furnished under the terms of the contract. <br />21 <br />22 <br />23 1-05.12(1).RTF <br />24 Add the following new section: <br />25 <br />26 1-05.12(1) One-Year Guarantee Period <br />27 (March 8, 2013 APWA GSP <br />28 <br />29 The Contractor shall return to the project and repair or replace all defects in <br />30 workmanship and material discovered within one year after Final Acceptance of the <br />31 Work. The Contractor shall start work to remedy any such defects within 7 calendar <br />32 days of receiving Contracting Agencys written notice of a defect, and shall complete <br />33 such work within the time stated in the Contracting Agencys notice. In case of an <br />34 emergency, where damage may result from delay or where loss of services may <br />35 result, such corrections may be made by the Contracting Agencys own forces or <br />36 another contractor, in which case the cost of corrections shall be paid by the <br />37 Contractor. In the event the Contractor does not accomplish corrections within the <br />38 time specified, the work will be otherwise accomplished and the cost of same shall <br />39 be paid by the Contractor. <br />40 <br />41 When corrections of defects are made, the Contractor shall then be responsible for <br />42 correcting all defects in workmanship and materials in the corrected work for one <br />43 year after acceptance of the corrections by Contracting Agency. <br />44 <br />45 This guarantee is supplemental to and does not limit or affect the requirements that <br />46 the Contractors work comply with the requirements of the Contract or any other legal <br />47 rights or remedies of the Contracting Agency. <br />48
