If aggressive or violent <br />2 individuals are encountered, the Contractor shall notify the local law enforcement <br />3 agency to assist them in clearing the Work area. <br />4 <br />5 Site cleanup of individual areas identified in the Health and Safety Plan shall be <br />6 performed no more than 30 days in advance of performing other Work in each <br />7 area. <br />8 <br />9 The refuse generated by the site cleanup shall become the property of the <br />10 Contractor and shall be removed from the project. Personal property shall be <br />11 handled as required by this Specification and applicable laws. <br />12 <br />13 Removal, Storage and Return of Personal Property <br />14 Personal property may include radios, audio and video equipment, sleeping <br />15 bags, tents, stoves and cooking utensils, lanterns, flashlights, bed rolls, tarps, <br />16 foam, canvas, mats, blankets, pillows, medication, personal papers, <br />17 photographs, books and other reading materials, luggage, backpacks or other <br />18 storage containers, clothing, towels, shoes, toiletries and cosmetics, clocks and <br />19 watches, and eye glasses. Personal property does not include building materials <br />20 such as wood products, metal, or rigid plastic. <br />21 <br />22 Personal property items that are not refuse, contaminated, illegal or hazardous <br />23 shall be removed from the Work area and stored at a location near the project <br />24 site for return to the property owner. Items shall be placed in large transparent <br />25 plastic bags and stored in a manner that protects them from adverse weather <br />26 and theft. Reasonable efforts shall be made to place all items from each <br />27 encampment into a separate bag. Each bag shall be labeled with an inventory <br />28 to include a brief description of the contents, a description of the location that it <br />29 was removed from, and the date that it was removed from the Work area. The <br />30 Contractor shall not open closed items of personal property unless, in its <br />31 determination, it is necessary to do so to protect public safety. <br />32 <br />33 The Contractor shall retain the property for 70-days. <br />34 <br />35 If the name and contact information of the owner of a personal property item is <br />36 identified on that item, then for a period of not less than 10-days after removing <br />37 the property from the Work area, the Contractor shall attempt to notify the <br />38 apparent owner of the property and make arrangements for the owner to claim <br />39 the property. <br />40 <br />41 The Contractor shall release the property to any individual who claims ownership <br />42 provided they are able to establish ownership by identifying the property and its <br />43 approximate location. The Contractor shall maintain a record of all property that <br />44 is claimed. The record shall include a description of the property, the date <br />45 claimed, and the name of the claimant. <br />46 <br />47 If personal property is not claimed within 70-days of removal from the <br />48 encampment, then the property shall become the property of the Contractor and <br />49 shall be removed from the project. <br />50
