11. Fertilizer manufacture; <br /> 12. Sanitary landfills; <br /> 13. Waste to energy facilities; <br /> 14. Solid waste transfer stations; <br /> 15. Sewage treatment plants; <br /> 16. Lumber,pulp or paper mills; <br /> 17. Cargo container storage; <br /> 18. Asphalt or concrete batch plant; <br /> 19. Other similar heavy manufacturing uses with potentially noxious impacts, <br /> as determined by the planning director, except as otherwise provided by this <br /> chapter. In making such a determination,the city shall use Review Process II and <br /> the notice and appeals provisions attendant thereto. <br /> Section 44: Section 27.030 of Ordinance No. 1671-89, as amended (EMC 19.27.030), <br /> which reads as follows: <br /> 27.030 Land developments authorized by the city prior to the effective date of the <br /> ordinance codified in this title. Land developments located in the M-1 zone which were <br /> authorized by the city prior to the effective date of the ordinance codified in this title <br /> which have standards, conditions or requirements which are different than required by <br /> this chapter shall be required to abide by such standards, conditions or requirements <br /> applied as part of a previous approval unless such previous approvals are amended by the <br /> city. In no case shall the standards, conditions or requirements be amended to be less <br /> restrictive than the least restrictive of the following: <br /> A. The previous development approval authorized by the city; <br /> B. The minimum standards of the M-1 zone; <br /> C. An authorization granted through the variance procedure described in Chapter 41 <br /> of this title; <br /> D. Development approved using the PD planned development-overlay zone. <br /> Is hereby amended to read as follows: <br /> 27.030 Land developments authorized by the city prior to the effective date of the <br /> ordinance codified in this title. Land developments located in the M-1 zone which were <br /> authorized by the city prior to January 13, 1990, which have standards, conditions or <br /> requirements which are different than required by this chapter shall be required to abide <br /> by such standards, conditions or requirements applied as part of a previous approval <br /> unless such previous approvals expire or are amended by the city. In no case shall the <br /> standards, conditions or requirements be amended to be less restrictive than the least <br /> restrictive of the following: <br /> A. The previous development approval authorized by the city; <br /> B. The minimum standards of the M-1 zone; <br /> C. An authorization granted through the variance procedure described in Chapter 41 <br /> of this title; <br /> D. Development approved using the PD planned development-overlay zone. <br />
