• The proposed project must comply with all applicable local, state and federal regulations and <br /> development standards. <br /> • The proposed project is not an essential public facility. <br /> The request to reduce the landscape from 15 feet to 10 feet along the west side of the building, and <br /> from 15 feet to 5 feet along the north elevation of the building is approved.The request to reduce the <br /> landscape from 15 feet to 5 feet along the north interior lot line is not approved. <br /> A SEPA threshold determination is not required for this proposal per 43.21C.031 RCW. This <br /> determination is dependent upon compliance with the SW Everett Subarea Plan Mitigation Decision <br /> Document and all local, state, and federal regulations related to general environmental protection <br /> including, but not limited to, right-of-way improvement requirements, drainage, etc. The decision and <br /> determination were made after review of a completed environmental checklist and other information <br /> on file with the lead agency. No appeal of the director's determination that a project qualifies as a <br /> planned action is provided. The decision pertaining the landscape modification requests may be <br /> appealed to the City's Land Use Hearing Examiner. For information about appeals, please refer to <br /> Everett Municipal Code 15.02, or contact Niels Tygesen: ntygesen@everettwa.gov. <br /> A final decision of overall project approval will be based on construction permit application review. <br /> Please note that city departments will need to review the proposed construction drawings through the <br /> appropriate permit submittals for compliance with city codes and standards. <br /> APPLICABLE CONDITIONS FROM SW EVERETT/PAINE FIELD MITIGATION DECISION DOCUMENT: <br /> SECTION 1: LAND USE <br /> 1.3.1. Height.All development with structures more than 200 feet in height and those within 20,000 feet <br /> of Paine Field must check with the FAA to determine if notification is required. (SEPA Land and <br /> Shoreline Use Policies) <br /> 1.3.5. Rockeries and retaining walls greater than 4 feet in height and 40 feet in length that are visible <br /> from adjacent properties or public right of way shall be substantially screened with landscaping or <br /> architecturally designed and landscaped to break up the appearance of length/height in a manner <br /> approved by the Planning Director. Rockeries and retaining walls within required landscape areas shall <br /> not be counted in the required landscaping width. (SEPA Land and Shoreline Use Policies) <br /> 1.3.6. Historic and Cultural Preservation. If any archaeological resources or human remains are found <br /> during construction,the project proponent shall contact the Tulalip Tribes,the City of Everett Planning <br /> Department, and the State Office of Archaeology and Historic Preservation. This contact will initiate a <br /> consultation process for determining subsequent actions. (SEPA Land and Shoreline Use Policies) <br /> SECTION 2:TRANSPORTATION <br /> 2.3.1.
