A. NWS will maintain copies of release waivers, and documentation of the number of <br /> participants and spectators in attendance, inspections performed, maintenance <br /> performed, and any accidents or incidents that happen on site. Documentation will stay <br /> on site at Kasch Park Ballfield Complex and shall be made available upon request to City <br /> staff. <br /> B. NWS will notify City Parks & Facilities Director, or designee, as soon as possible when an <br /> accident or incident occurs involving the Ballfield Property. NWS is responsible for <br /> completing appropriate City forms for reporting accidents and incidents and submitting <br /> them to City Parks & Facilities Director or designee within one business day. <br /> 8. Other NWS Responsibilities and Requirements: <br /> A. NWS will not remove or consume any property belonging to the City or City employees. <br /> B. Hazardous conditions shall be immediately remedied or secured to prevent further <br /> damage and/or protect Kasch Park Baseball Complex visitors from injury. It is the <br /> responsibility of the NWS to provide close supervision of all operations when on site. <br /> C. NWS will ensure that employees comply with all Washington State industrial regulations <br /> and practices. <br /> D. NWS shall not enter into contracts regarding the Ballfield Property without the prior <br /> written approval of each such contract by the City Parks & Facilities Director or <br /> designee, except this approval is not required for concessions subcontracts under <br /> Section 4 of this Exhibit B. Every subcontract must contain a provision stating that the <br /> subcontract automatically terminates when this Agreement terminates. <br /> E. No reserved parking will be made available for the NWS, NWS staff, or NWS's <br /> customers. Parking is available on a first come, first serve basis. <br /> F. NWS will ensure that NWS maintains and remains in compliance with all legally required <br /> licenses. <br /> G. NWS will be responsible for providing first aid kits and replacing supplies as needed. <br /> H. NWS is responsible at NWS's cost for the care, maintenance, and replacement of its own <br /> personal property and equipment. <br /> I. The City reserves the right to close Kasch Park, including the Ballfield Property(Kasch Park <br /> Ballfield Complex Fields 1-4) and associated parking lots in the event of inclement <br /> weather, natural disasters, hazardous situations, or other emergency building closures. <br /> J. City will work closely with NWS to schedule all planned closure dates to best avoid or <br /> reduce operational impacts. Whenever reasonably possible, the City will notify NWS no <br /> less than 30 days in advance of planned closures or maintenance activities that could <br /> affect NWS operations. <br /> 9.
