3.0 REGULATORY SETTING <br /> 3.1 CITY OF EVERETT WETLAND AND STREAM CLASSIFICATIONS <br /> Pursuant to EMC 19.37.090(C),wetlands are classified according to the Department of Ecology's <br /> (DOE)Washington State Wedand Rating System for Western Washington: 2014 Update (Hruby <br /> 2014), or as revised. As described in EMC 19.37.160(A), classification of streams shall be <br /> established in accordance with the water typing rules contained in WAC 222-16-030. Protective <br /> buffers are assigned to wetlands and streams based upon these classifications, as provided in EMC <br /> 19.37.110(A) and 19.37.170(A)(3), respectively. The wetlands within the vicinity of the property <br /> are classified as follows: <br /> Wetland A—Category III:Wetland A is classified as a Category III depressional wetland with <br /> a total score of 19 points and habitat score of 6 points. Wetland A receives standard buffer of 130 <br /> feet. <br /> Silver Lake Creek—Type F: Silver Lake Creek is a Type F stream. The buffer of Silver Lake <br /> Creek does not feature intact native vegetation for 100 feet from the stream boundary and therefore <br /> the stream receives a standard buffer of 150 feet. <br /> Silver Lake—Type S: Silver Lake is a 99.3-acre lake and a Type S water. Silver Lake is regulated <br /> by the City of Everett SMP and does not have a listed buffer. The project area is located within <br /> 200 feet of the lakeshore and therefore falls within shoreline jurisdiction. <br /> 3.2 ADDITIONAL REQUIRED DOCUMENTATION <br /> Table 37.1 of the Everett Municipal Code lists required documentation when proposing <br /> development in or near protected critical areas.The project area is located within 200 feet of Silver <br /> Lake and therefore must comply with the City of Everett SMP. A shoreline narrative is provided <br /> below in Section 4 of this report. The project is also sited within 200 feet of Silver Lake Creek, a <br /> Type F water, and therefore requires a Biological Assessment for federally listed threatened or <br /> endangered species. Additionally, a Habitat Assessment will be provided to discuss potential <br /> impacts on regulated threatened or endangered species. The Biological Assessment and Habitat <br /> Assessment have been provided in Section 5 of this report. <br /> 3.3 SPECIAL FLOOD HAZARD AREAS <br /> FEMA has delineated special flood hazard areas and risk zones, which are identified on FEMA's <br /> Flood Insurance Rate Maps (FIRMS). Snohomish County participates in the National Flood <br /> Insurance Program (NFIP), which requires the adoption of floodplain management ordinances to <br /> reduce flood damage. <br /> No disturbance has or is proposed to occur within a special flood hazard area; therefore, a Flood <br /> Hazard Permit is not required. <br /> Charter Club Apartments 7 WRI#23061 <br /> Critical Area Report&Miti ation Plan November 6, 2023 <br />
