5.0 IMPACT ASSESSMENT <br /> The City of Everett violation notice (Case No. CE19-0561) indicates that streambank vegetation <br /> and a beaver dam were removed from the critical area,wetland, stream, and/or buffer.A hearing <br /> before the Hearing Examiner of the City of Everett took place on October 3, 2019 regarding the <br /> violation. Applicable Everett Municipal Code (EMC) violations include violations of EMC <br /> 19.37.030(A) and (B), and EMC 19.37.040(B), (D), and (E). <br /> WRI estimated and delineated the subject area of impact at approximately 460 square feet. The <br /> area impacted includes an approximate 8-foot strip of stream buffer along the west side of the <br /> channel. Based upon historic aerial photography from Google Earth (see Figure 4), Bing Street <br /> View photography (see Figure 3), and adjacent vegetation growth, previous conditions of the <br /> impacted stream bank/buffer consisted of native and invasive trees, shrubs, and groundcover, <br /> dominated by Sitka willow(Salix sitchensis),Pacific willow(Salix lucida),salmonberry(Rubus spectabilis), <br /> Himalayan blackberry(Rubus armeniacus), reed canarygrass (Phalaris arundinacea), creeping buttercup <br /> (Ranunculus repens), field horsetail (Equisetum arvense),white clover (Trifolium repens), curly dock(Rumex <br /> crispus), and field bindweed (Convolvulus arvensis). The vegetated portion of the buffer is consistently <br /> shown to be a maximum of 8 feet-wide west of the ordinary high water mark. Historic aerial and <br /> street view photography also consistently shows the area between the detached garage and <br /> vegetated stream buffer to be composed of mowed herbaceous vegetation, and used for vehicle <br /> storage.
