<br />Fulton Street Pedestrian Bicycle Corridor PAGE 60 OF 114 CONTRACT <br />FEDERAL AID # TAP-0420(026) <br />WO #3785 September 6, 2024 <br /> <br />Prior to any subcontractor or lower tier subcontractor beginning work, the Contractor 1 <br />shall submit to the Engineer a certification (WSDOT Form 420 -004) that a written 2 <br />agreement between the Contractor and the subcontractor or between the subcontractor 3 <br />and any lower tier subcontractor has been executed. This certification shall also 4 <br />guarantee that these subcontract agreements include all the documents required by the 5 <br />Special Provision Federal Agency Inspection. 6 <br /> 7 <br />A subcontractor or lower tier subcontractor will not be permitted to perform any work 8 <br />under the contract until the following documents have been completed and submitted to 9 <br />the Engineer: 10 <br /> 11 <br />1. Request to Sublet Work (WSDOT Form 421-012), and 12 <br /> 13 <br />2. Contractor and Subcontractor or Lower Tier Subcontractor Certification for Federal -14 <br />aid Projects (WSDOT Form 420-004). 15 <br /> 16 <br />The Contractor shall submit to the Engineer a completed Monthly Retainage Report 17 <br />(WSDOT Form 272-065) within 15 calendar days after receipt of every monthly progress 18 <br />payment until every subcontractor and lower tier subcontractor’s retainage has been 19 <br />released. 20 <br /> 21 <br />The Contractor's records pertaining to the requirements of this Special Provision shall be 22 <br />open to inspection or audit by representatives of the Contracting Agency during the life of 23 <br />the contract and for a period of not less than three years after the date of acceptance of 24 <br />the contract. The Contractor shall retain these records for that period. The Contractor 25 <br />shall also guarantee that these records of all subcontractors and lower tier 26 <br />subcontractors shall be available and open to similar inspection or audit for the same 27 <br />time period. 28 <br /> 29 <br />1-08.1(7).GR1 30 <br />Payments to Subcontractors and Lower-Tier Subcontractors 31 <br /> 32 <br />1-08.1(7)A.OPT1.2025.GR1 33 <br />(July 2, 2024) 34 <br />The Contractor shall report the actual amounts paid to all firms that were used 35 <br />as subcontractors of any tier, materials suppliers, manufacturers, regular 36 <br />dealers, or service providers on the Contract, including all Disadvantaged, 37 <br />Minority, Small, Veteran, or Women’s Business Enterprise firms. The following 38 <br />do not need reported: (1) retail sales or services that are paid for at the time of 39 <br />purchase; (2) payments to materials suppliers or manufacturers that are in 40 <br />normal course of business. The Contractor shall report this information by 41 <br />entering it into the Contracting Agency’s Diversity Management and Compliance 42 <br />System at: https://wsdot.diversitycompliance.com. Payments shall be reported 43 <br />no later than the 20th of the month for all payments made to firms during the 44 <br />previous calendar month. For example, the Contractor shall enter all payments 45 <br />made to firms during the month of March into DMCS by April 20 th. Payments 46 <br />shall be reported between execution of the Contract and the Contract 47 <br />Completion Date. When no Work occurred or no payments were made for a firm, 48 <br />the reported payment shall be zero. 49 <br /> 50
