<br /> Page 23 of 42 FINAL 2/21/25 Agreement No. 2025-02 <br />Forest Product measurement and weighing facilities required by this Contract must be <br />approved by the City. Forest products sold under the Contract which require log <br />scaling shall be scaled, measured, or counted by a City approved third party log scaling <br />organization. Forest products sold under the Contract which require weighing shall be <br />weighed at a location that meets Washington State Department of Agriculture approval. <br /> <br />Prior to forest products being hauled, the Contract Administrator must authorize in <br />writing the use of City approved measurement and/or weighing facilities that are at or <br />enroute to final destinations. Forest products from this sale shall be measured or weighed at <br />facilities, which are currently approved for use by the City and are currently authorized for <br />this sale. The City reserves the right to verify load volume and weights with City employees <br />or contractors at the City’s own expense. The City reserves the right to revoke the <br />authorization of previously approved measurement locations. <br /> <br />L-130 Conversion Factors <br /> <br />Forest products removed from the sale area that are not measured in units specified in <br />the 'Payment for Forest Products' clause of this contract shall be converted to board feet <br />using Washington Department of Natural Resources' standard conversion factors. <br />SECTION H: HARVESTING OPERATIONS <br />H-01 Operations Outside the Sale Boundaries <br /> No operations shall occur outside the sale boundaries, as described within the Contract, <br />unless approved in writing by the City. <br />H-11 Certification of Cutters and Yarder Operators <br />All persons engaged in the cutting and yarding of timber must receive certification in <br />writing from the Contract Administrator. Certification may be revoked when the <br />Contract Administrator determines non-compliance to the salvage cutting prescription or <br />any other contractual condition. <br /> <br />H-12 Leave Tree Damage Definition <br /> All standing live trees and snags are considered leave trees that are required for retention <br />within the sale boundary. Purchaser shall protect all leave trees from being cut, damaged, or <br />removed during operations. Leave trees that need to be cut for safety or yarding purposes <br />must be approved by the Contract Administrator prior to falling. <br /> <br />Leave tree damage exists when more than 5 percent of the leave trees are damaged in a unit <br />and when one or more of the following criteria occur as a result of Purchaser's operation, as <br />determined by the Contract Administrator: <br /> <br />a. A leave tree has one or more scars on its trunk exposing the cambium layer, <br />which in total exceeds 20 square inches.
