all criteria, restrictions, and requirements of the Presidential Disaster Declaration <br />HMGP document, the Manual the DHS Award Letter for the Grant, and the <br />federal regulations commonly applicable to DHS/FEMA grants. <br />The SUBRECIPIENT shall be responsible to the DEPARTMENT for ensuring <br />that all HMGP federal award funds provided to its subrecipients, and associated <br />matching funds, are used in accordance with applicable federal and state <br />statutes and regulations, and the terms and conditions of the federal award set <br />forth in Attachment 2 of this Agreement. <br />2. PROJECT FUNDING <br />The DEPARTMENT will administer 5320-23-R and will pass through the federal match and <br />commit the available state match. The SUBRECIPIENT will commit the required local match. <br />a. The total cost of the project for the purposes of this Agreement is $946,895.00 dollars; <br />P ROVIDED that, if the total cost of the project when completed, or when this Agreement <br />is terminated, is actually less than above, the actual cost shall be substituted herein. <br />b. The value of the contributions by the SUBRECIPIENT to the project shall be $118,361.88 <br />dollars, or 12.5 percent, at minimum, of the total project cost. The SUBRECIPIENT's <br />contributions may be cash or in -kind, must be from a non-federal source, must be <br />reasonable, allowable and allocable, and must comply with all Federal requirements and <br />regulations. <br />c. When the DEPARTMENT enters into an agreement with the Federal Emergency <br />Management Agency (FEMA) to contribute federal funds to this project, that federal <br />contribution will be $710,171.25 dollars, or 75 percent of the total project cost, whichever <br />is less. <br />d. The value of the contributions by the DEPARTMENT to the project shall be $118,361.87 <br />dollars, or 12.5 percent, at minimum, of the total project cost and is contingent on <br />legislative approval of DEPARTMENT funding pursuant to the prerequisites provided in <br />subsection g. The DEPARTMENT's contributions must be from a non-federal source and <br />must comply with all Federal requirements and regulations. <br />e. The Federal Emergency Management Agency (FEMA) has contributed federal funds for <br />S UBRECIPIENT Management Costs (SubMC) SubMC includes costs for administering <br />the grant and indirect costs. This federal contribution is in addition to the federal award for <br />project costs and is suitable for 100% reimbursement for eligible expenses. The maximum <br />amount available for SubMC is $47,344.75 dollars, limited to 5% of the eligible project <br />expenditures for administrative, indirect, or overhead costs, whichever is less. <br />f The DEPARTMENT shall not be obligated to pay any amount beyond that set out in <br />S ubsections c, d, and e above, unless that additional amount has been approved in <br />advance by both the DEPARTMENT and SUBRECIPIENT and is incorporated by written <br />amendment into this Agreement. <br />g. The Washington State Legislature may authorize the DEPARTMENT to provide a match <br />to the SUBRECIPIENT's non-federal share of eligible projects. Provision of a match by <br />the DEPARTMENT, if authorized by the Washington State Legislature, shall not require <br />amendment of this Agreement. If DEPARTMENT match funds are committed to the non- <br />federal share by the DEPARTMENT pursuant to legislative authorization, the <br />DEPARTMENT will formally notify the SUBRECIPIENT of the match in writing which will <br />include information identifying any related reduction in the SUBRECIPIENT's percentage <br />commitment. <br />h. A written amendment will be required if the SUBRECIPIENT expects cumulative transfers <br />between project budgets, as identified in the Project budget (Attachment 5) and the <br />Statement of Work and/or description of Project (Attachment 3), to exceed 10% of the <br />Grant Agreement Amount.
