SNO-ISLE TECH 2O23 SMALL WORKS Section 00 70 00, Page 8 <br />McGRANAHAN ARCHITECTS GENERAL CONDITIONS T <br />2.2.3 Upon request, the Contractor will be furnished free of charge up to ten (10) copies, if available, <br />of Drawings and Specifications from copies returned to Owner from the bidding procedure, including <br />up to ten (10) copies of revised Drawings, Addenda, or Supplementary drawings. Additional sets beyond <br />those readily available to the Owner will be furnished at the cost of reproduction and delivery. <br />2.2.4 The foregoing are in addition to other duties and responsibilities of the Owner enumerated herein <br />and especially those in respect to Article 6 (Construction by Owner or by Separate Contractors), Article <br />9 (Payments and Completion) and Article 11 (Insurance and Bonds). <br />2.3 OWNER'S RIGHT TO STOP THE WORK <br />2.3.1 If the Contractor fails to correct Work which is not in accordance with the requirements of the <br />Contract Documents as required by Paragraph 12.2 or fails to carry out Work in accordance with the <br />Contract Documents, the Owner, by written order signed personally or by an agent specifically so <br />empowered by the Owner in writing, may order the Contractor to stop the Work, or any portion thereof, — <br />until the cause for such order has been eliminated; however, the right of the Owner to stop the Work <br />shall not give rise to a duty on the part of the Owner to exercise this right for the benefit of the Contractor <br />or any other person or entity, except to the extent required by Subparagraph 6.1.3. Owner will exercise <br />the right to stop work only if Contractor's performance deviates from the requirements of the Contract <br />Documents in a material way that is damaging to the interests of the Owner as determined by the Owner. <br />2.4 OWNER'S RIGHT TO CARRY OUT THE WORK <br />2.4.1 If the Contractor defaults or neglects to carry out the work in accordance with the Contract <br />Documents and fails within a seven-day period after receipt of written notice from the Owner to <br />commence and continue correction of such default or neglect with diligence and promptness, the Owner <br />may, without prejudice to other remedies the Owner may have, correct such deficiencies. In the event <br />such deficiencies threaten the health or safety of Owners, employees, students or occupants, or exist <br />within fourteen (14) calendar days of the date on which the Owner is scheduled to begin to operate school <br />at the Project, the Owner may proceed to correct such deficiencies with such notice to the Contractor as <br />is reasonable under the circumstances, which notice shall not exceed forty-eight (48) hours. When the <br />Owner has undertaken to carry out a portion of the work prior to final acceptance of the contract, an <br />appropriate Modification shall be issued deducting from payments then or thereafter due the Contractor <br />the cost of correcting such deficiencies, including compensation for the Architect's additional service <br />and expenses made necessary by such default, neglect or failure; and the amounts charged to the <br />Contractor are subject to the prior review of the Architect as to decisions and amounts charged. If <br />payments then or thereafter due the Contractor are not sufficient to cover such amounts, the Contractor <br />shall promptly pay the difference to the Owner. <br />2.4.2 In the exercise of the Owner's right to carry out the Work, the Owner shall have the right to use <br />the Owner's own forces or hire another Contractor, with or without public bid, to carry out such work. <br />mcg-ARC 2120.000 February 28, 2023 <br />
