The distance provided for line of sight shall be measured by following a straight line from the 1 <br />nearest point of the property parcel upon which the secure community transitfon facility is to be 2 <br />located, to the nearest point of the parcel of property or land use district boundary line from 3 <br />which the proposed land use is to be separated. 4 <br />3. In order to assist in providing equitable distributfon, there shall be a separatfon of one mile 5 <br />between an SCTF and any existfng SCTF, jail, correctfonal facility, mental health facility, work 6 <br />release, pre-release or similar facility. (A “similar facility” includes, but is not limited to, Madison 7 <br />House, Everett Gospel Mission Men Shelter, Everett Gospel Mission Women and Children Shelter, 8 <br />Green House, Evergreen Manor and establishments providing similar services.) 9 <br />D. Review Process III (Special Property Use/Conditfonal Use Permit). A conditfonal use permit Review 10 <br />Process III applicatfon for SCTF shall comply with all the permitting and procedural requirements 11 <br />pertaining to a conditfonal use permit Review Process III including those found under EMC Title 15. 12 <br />E. Existfng SCTFs. In the event a SCTF is legally sited in accordance with the provisions of this tftle, this 13 <br />does not preclude any subsequent sitfng of any risk potentfal actfvity described in subsectfon (C)(1) of 14 <br />this sectfon within the line of sight. 15 <br />F. When evaluatfng an applicatfon for a SCTF consideratfon shall also be given to those sitfng provisions 16 <br />provided in RCW 71.09.250(8). 17 <br />19.08.300 ADMINISTRATIVE MODIFICATION OF DEVELOPMENT STANDARDS. 18 <br />A. General. An applicant may propose and the planning director, using the review process described in 19 <br />EMC Title 15, Local Project Review Procedures, may allow an applicant to deviate from the development 20 <br />standards, provided the proposal satfsfies the evaluatfon criteria of this subsectfon. In evaluatfng such a 21 <br />proposal, the planning director, using the criteria in subsectfon (C) of this sectfon, shall determine if the 22 <br />alternatfve design or plan provides superior results to that which would be required by compliance with 23 <br />the development standards of this chapter. 24 <br />B. Development Standards That Can Be Modified. 25 <br />1. The following development standards in this chapter can be modified: 26 <br />a. Any design or development standard regarding facade, window, door, roof, entrance 27 <br />or siding requirements. 28 <br />b. Lot width requirements (REV II). 29 <br />c. Landscape requirements. 30 <br />db. Minimum size, locatfon and design standards for on-site open space shared or 31 <br />private yards (REV II). 32 <br />2. The following development standards cannot be modified: 33 <br />a. Minimum lot size requirements. 34 <br />b. Maximum density requirements. 35 <br />c. Lot coverage requirements. 36
