Approval may only be granted if it can be demonstrated 2 <br />that such height is necessary to adequately serve the needs of the public for the proposed utflity or 3 <br />communicatfons service. The applicant shall provide an evaluatfon of alternatfve designs and locatfons 4 <br />which could result in a lower tower or antenna height. 5 <br />G. Towers associated with aboveground utflity and communicatfon facilitfes and all ancillary structures 6 <br />shall comply with the setback standards of the zone in which the property is located; provided, that 7 <br />when allowed to be located in or within two hundred feet of residentfal zones, the height of any tower 8 <br />shall not exceed the horizontal distance between the base of the tower and the nearest residentfal 9 <br />property line. The review authority, in considering the proposed utflity or communicatfons facility, may 10 <br />allow a lesser setback without having to satfsfy the variance approval criteria of EMC 15.03.140, if it can 11 <br />be demonstrated that a lesser setback is necessary to adequately serve the needs of the public for the 12 <br />proposed utflity or communicatfons service, or that a lesser setback will result in better screening than in 13 <br />a locatfon which meets the setbacks required herein. 14 <br />H. The aboveground utflity or communicatfons facility shall be removed from the site should the use for 15 <br />such purposes be discontfnued for one hundred twenty days or more. The planning director shall have 16 <br />the discretfon, upon the request of the owner of the facility, to allow an extension of this tfme period to 17 <br />allow for the use of the site by another utflity or communicatfons service provider. 18 <br />I. Maintenance, repair, or replacement of existfng utflity or communicatfons facilitfes or appurtenant 19 <br />structures and the installatfon of minor aboveground utflity and communicatfons facilitfes are exempt 20 <br />from this sectfon. This exemptfon includes replacement or increased heights of not more than twenty 21 <br />feet to accommodate wireless telecommunicatfons antennas. Utflity and communicatfons service 22 <br />providers are encouraged to locate such facilitfes of a minor nature and small scale on existfng or 23 <br />replacement structures, where technically feasible, in preference to erectfng new towers or structures 24 <br />for such purposes. 25 <br />J. To the extent provided by law, the city may require utflity or communicatfons service provider to 26 <br />allow up to two additfonal service providers to be located on shared facilitfes to discourage the 27 <br />proliferatfon of tower structures, consistent with technological feasibility. The review authority may 28 <br />allow an additfonal twenty feet in tower height per additfonal provider to accommodate collocatfon. 29 <br />K. Utflity or communicatfons facilitfes which require towers for which safety lights are required by the 30 <br />FAA shall not be permitted unless the applicant demonstrates that such a facility in the proposed 31 <br />locatfon and at such a height is necessary to adequately serve the needs of the public for the proposed 32 <br />utflity or communicatfons service. 33 <br />L. The planning director may require review by an expert third party who is approved by the city and 34 <br />the applicant, to be paid for by the applicant, when needed for review of site-specific data submitted by 35 <br />the applicant concerning technical aspects related to specific facilitfes and locatfons. 36 <br />19.13.030, ADAPTIVE REUSE OF NONRESIDENTIAL BUILDINGS 37 <br />A. Purpose. The purpose of this sectfon is to allow for adaptfve reuse of nonresidentfal buildings in 38 <br />residentfal zones that are functfonally obsolete in order to improve the economic feasibility of a property 39
