Other uses not listed above if determined through the review process to be 1 <br />compatible with surrounding properties and the immediate vicinity. 2 <br />E. Review Criteria. The following criteria shall be used as the basis for determining compatibility 3 <br />with surrounding uses and approving, denying, or conditionally approving a request to allow 4 <br />the adaptive reuse of a nonresidential building in a residential zone: 5 <br />1. Evaluation criteria set forth in EMC 15.03.100. 6 <br />2. The adaptive reuse would promote or aid in the preservation or rehabilitation of the 7 <br />primary building. 8 <br />3. No signiflcant adverse impacts to public safety. 9 <br />4. Compliance with building and flre codes. 10 <br />5. Hours of the day of proposed use or activity. 11 <br />6. Proposed management and operational procedures to minimize and mitigate 12 <br />potential impacts. 13 <br />7. Expansions to the primary building shall not exceed ten percent of the existing 14 <br />footprint or flve hundred square feet, whichever is greater, and will not detrimentally 15 <br />affect the outside character of the building. 16 <br />8. Other factors not specifled herein that would create adverse impacts to the 17 <br />immediate vicinity. 18 <br />9. Any proposal that would adversely affect properties in the immediate vicinity shall be 19 <br />denied. The city shall retain the right to revoke a permit issued under this section that fails to 20 <br />comply with any conditions of approval of said permit, or which operates in a manner 21 <br />inconsistent with representations made in the application, pursuant to Chapter 1.20 EMC. 22 <br />Reserved. An adult retail business shall not be located or maintained within two hundred flfty feet, 25 <br />measured from the nearest property line of the adult retail use establishment to the nearest 26 <br />property line of any of the following uses or zones located inside or outside of the city of 27 <br />Everett: 28 <br />1. Public library; 29 <br />2. Public playground or park; 30 <br />3. Public or private school and its grounds, from kindergarten to twelfth grade; 31 <br />4. Nursery school or day care center; 32 <br />5. Church, temple, mosque, synagogue, or other place of religious worship; 33
