Stream crossings are regulated by the Washington State 1 <br />Department of Fish and Wildlife (WDFW). Stream crossings shall only be permitted as 2 <br />provided by EMC 19.37.050 or to provide access to a lot or a substantfal portfon of a lot 3 <br />when no other feasible means of access exists. Use of common access points shall be 4 <br />required for abutting lots which have no other feasible means of access. Alteratfon for 5 <br />the purpose of providing access shall be limited to the minimum number of stream 6 <br />crossings required to permit reasonable access. Bridging may be required when 7 <br />necessary to protect significant stream functfons. If a culvert is allowed, the design and 8 <br />installatfon must be approved by WDFW; 9 <br />c. When the proposal results in significant restoratfon of functfons to the stream 10 <br />segment and the alteratfon is approved by the Washington State Department of Fish and 11 <br />Wildlife. 12 <br />3. Type Np and Type Ns Streams. 13 <br />a. Except as provided in this subsectfon, no alteratfon of a Type Np or Ns stream shall 14 <br />be allowed except as otherwise provided by EMC 19.37.050; or 15 <br />b. The planning director may, using the review process described in EMC Title 15, Local 16 <br />Project Review Procedures, allow alteratfon or relocatfon of Type Np and Ns streams 17 <br />under the following conditfons: 18 <br />(1) Stream and buffer functfons in the relocated/altered stream sectfon must 19 <br />be equal to or greater than the functfons provided by the stream and buffer 20 <br />prior to relocatfon/alteratfon; 21 <br />(2) The equivalent base flood storage volume shall be maintained; 22 <br />(3) There shall be no impact to local ground water; 23 <br />(4) There shall be no increase in water velocity; 24 <br />(5) There is no interbasin transfer of water; 25 <br />(6) The relocatfon shall occur on site and shall not result in additfonal 26 <br />encumbrances on neighboring propertfes unless necessary easements and 27 <br />waivers are obtained from affected property owners; 28 <br />(7) The relocatfon maintains or enhances existfng connectfons to other critfcal 29 <br />areas and priority habitats. 30 <br />c.
