If a culvert is allowed, the design and 1 <br />installatfon must be approved by WDFW. 2 <br />4. Watershed Management Plans. The city shall not allow relocatfon or alteratfon of any Type F 3 <br />stream located within an area where an adopted watershed management plan does not allow 4 <br />for stream alteratfon or relocatfon, except when allowed by EMC 19.37.050, or to allow access to 5 <br />a lot or substantfal portfon of a lot when no other feasible means of access exists. 6 <br />B. Compensating for Stream Impacts. Stream system and buffer alteratfon, when allowed by this 7 <br />chapter, shall be subject to the following requirements: 8 <br />1. Each actfvity/use shall be designed so as to minimize overall stream system or buffer 9 <br />alteratfon to the greatest extent possible. 10 <br />2. Constructfon techniques and field marking of areas to be disturbed shall be approved by the 11 <br />city prior to site disturbance to ensure minimal encroachment. 12 <br />3. A mitfgatfon plan shall be prepared in accordance with this sectfon. 13 <br />4. The city may require the applicant to rehabilitate a stream system and its buffer area by 14 <br />removing harmful debris, sediment, nonnatfve vegetatfon, or other material detrimental to the 15 <br />area, by replantfng disturbed vegetatfon, by removing tfghtlined or culverted portfons of a 16 <br />stream from pipes/culverts, or by other means deemed appropriate by the city. Rehabilitatfon or 17 <br />restoratfon may be required at any tfme that a conditfon detrimental to stream functfons exists. 18 <br />5. In approving alteratfon or relocatfon of a stream system or its buffer, the city may require 19 <br />that an area larger than the altered portfon of the stream and its buffer be provided as 20 <br />compensatfon for destructfon of the functfons of the altered stream system and to ensure that 21 <br />such functfons are replaced. 22 <br />6. When stream system relocatfon or compensatfon is allowed, the city shall require that the 23 <br />stream relocatfon be completed prior to allowing the existfng stream to be filled or altered. 24 <br />7. The city may limit certain development actfvitfes near a stream to specific months in order to 25 <br />minimize impacts on water quality and wildlife habitat. 26 <br />8. The city may apply additfonal conditfons or restrictfons, or require specific constructfon 27 <br />techniques, in order to minimize impacts to stream systems and their buffers. 28 <br />9. Stream compensatfon shall not occur in areas having high-quality terrestrial habitat. 29 <br />C. Voluntary Daylighting of Streams in Pipes and Culverts. 30 <br />1. To encourage daylightfng of streams in pipes and culverts, the planning director may modify 31 <br />development standards as set out in subsectfon C.2 of this sectfon when the applicant submits a 32 <br />plan for daylightfng that meets the following criteria: 33 <br />a. The plan is prepared by a qualified professional; 34 <br />b. The ecological functfons of the daylighted waters and adjacent area are improved so 35 <br />the new riparian corridor is compatfble with and protects the ecological functfons of the 36
