If the plan proposes daylightfng the pipe or culvert in a different locatfon on the 4 <br />parcel from its current locatfon or off the parcel, the ecological functfons required in 5 <br />subsectfon C.1.b of this sectfon are provided as effectfvely as they would be without the 6 <br />relocatfon. 7 <br />2. If the director finds the conditfons in subsectfon C.1 of this sectfon are met, the director may 8 <br />modify the following development standards. The modificatfon shall be the minimum to provide 9 <br />sufficient area to meet the standards in subsectfon C.1 of this sectfon and shall be in the 10 <br />following order of priority: 11 <br />a. Yard and/or setback requirements on the property may be reduced, unless reducing 12 <br />them is injurious to safety. 13 <br />b. The stream and adjacent buffer area may count toward required landscaping. 14 <br />c. The stream and adjacent buffer area may count toward open space requirements for 15 <br />all multfple-family and M-1 zone requirementsof EMC 19.09.050. 16 <br />d. Building heights may be increased. 17 <br />CHAPTER 19.38 NONCONFORMITIES 18 <br />19.38.010 PURPOSE AND INTENT. 19 <br />A. The purpose of this chapter is to regulate nonconforming structures, uses and lots. This chapter 20 <br />includes regulatfons for determining the legal status of nonconforming uses, structures and other site 21 <br />improvements by creatfng provisions through which they may be established, maintained, altered, 22 <br />reconstructed, expanded or abated. 23 <br />B. For additfonal requirements related to other nonconformitfes, see the following sectfons of this tftle: 24 <br />1. Open space and common areas—see Chapter 19.09 EMC for multffamily residentfal and 25 <br />Chapter 19.12 EMC for industrial uses; 26 <br />2. Adult use businesses—see Chapter 19.13 EMC; 27 <br />3. Parking—see Chapter 19.34 EMC; 28 <br />4. Landscaping—see Chapter 19.35 EMC; 29 <br />5. Signs—see Chapter 19.36 EMC; 30 <br />6.
