Additfons, maintenance or repair to a nonconforming structure which does not increase the 1 <br />nonconformity shall be permitted; provided the additfon, maintenance or repair complies with 2 <br />building and Unified Development Code requirements. 3 <br />2. A nonconforming structure which does not meet required setbacks or height may be 4 <br />expanded along the nonconforming setbacks or to the existfng nonconforming height if 5 <br />approved by the planning director; provided the following criteria are met: 6 <br />a. The expansion does not make the setback or height more nonconforming; 7 <br />b. The expansion shall not exceed twenty-five percent within the nonconforming 8 <br />setback or for the portfon of the structure that is nonconforming as to building height; 9 <br />and 10 <br />c. The expansion complies with all other requirements of this chapter, and the 11 <br />nonconformity has been certffied by the planning department. 12 <br />Figure 38-1: Expansion of Nonconforming Building 13 <br /> 14 <br />B. Damage or Destructfon. 15 <br />1. If a nonconforming structure is destroyed or damaged to any extent by fire or other casualty 16 <br />not intentfonally caused by the owner, the structure may be rebuilt if the following requirements 17 <br />are met: 18 <br />a. The nonconformity of the structure is certffied; 19 <br />b. A complete building permit applicatfon is properly filed within one year of such fire 20 <br />or other casualty; and 21 <br />c. Constructfon is commenced and completed in conformance with the provisions of 22 <br />the building code then in effect. This provision shall not reduce any requirements of the 23 <br />building or fire codes in effect when such structure is rebuilt. 24
