If a nonconforming structure which has no permanent foundatfon is destroyed and the 1 <br />foundatfon’s locatfon cannot be verified by the planning department, then any new constructfon 2 <br />shall comply with the requirements of this tftle. 3 <br />C. Demolitfon of Nonconforming Structures. Following the abatement or voluntary demolitfon of a 4 <br />nonconforming structure, any new constructfon shall be in conformance with this tftle, except in the 5 <br />following circumstances: 6 <br />1. A single-family dwelling or duplex detached dwelling unit which is nonconforming in 7 <br />setbacks, height or lot coverage may be voluntarily removed or demolished and replaced by a 8 <br />new detached dwelling unit single-family dwelling or duplex which has the same nonconforming 9 <br />setbacks, height or lot coverage as the prior nonconforming dwelling, provided; 10 <br />a. The nonconformity is not increased; 11 <br />b. The new dwelling unit meets all current building code requirements; and 12 <br />c. The nonconformity of the dwelling unit is certffied by the planning department. 13 <br />2. A detached accessory structure which is accessory to a detached dwelling unit single-family 14 <br />dwelling or duplex that has nonconforming setbacks may be demolished and a new accessory 15 <br />structure may be built in the same locatfon; provided: 16 <br />a. The new accessory structure does not exceed fifteen eighteen feet in height within 17 <br />the setback, or the height at which the structure was certffied above fifteen eighteen 18 <br />feet within the setback; 19 <br />b. The new accessory structure meets current building code requirements; and 20 <br />c. The locatfon of the nonconforming accessory structure is certffied by the planning 21 <br />department. 22 <br />3. A detached accessory structure that has nonconforming setbacks may be demolished and a 23 <br />dwelling unit may be built in the same locatfon; provided: 24 <br />a. The new dwelling unit meets current building code requirements; and 25 <br />b. The locatfon of the nonconforming accessory structure is certffied by the planning 26 <br />department. 27 <br />CHAPTER 19.40 FENCES 28 <br />19.40.010 FENCES HEIGHT AND LOCATION. 29 <br />A. Residentfal Zones—Fence Height and Setbacks. Fences shall not exceed a height of: 30 <br />1. Forty-two inches within the front setback or twenty feet of the abutting right-of-way abutting 31 <br />the front lot line. 32 <br />2. Six feet within the street side setback or the abutting right-of-way. 33 <br />3. Seven feet within the interior side or rear setbacks. 34
