Fences within the front setback or the abutting right-of-way twenty feet of the right-2 <br />of-way abutting the front lot line may be up to six feet in height if the fence is at least 3 <br />ten feet from the sidewalk, is at least seventy percent transparent from three feet to six 4 <br />feet, and is not chain link or other type of similar material. If no sidewalk exists, the 5 <br />minimum distance required is determined by the city engineer. 6 <br />b. For corner lots or double frontfng lots, the front and street side or rear fence heights 7 <br />can be switched if the front of the house faces the street side or rear. 8 <br />c. Arbors. Arbors may exceed the maximum fence height within the front setback for a 9 <br />distance of up to twenty percent of the lot frontage on the street, provided the height of 10 <br />the arbor does not exceed eight feet. 11 <br />d. Where a structure has a nonconforming front setback is within twenty feet of the 12 <br />right-of-way abutting the front lot line, a fence along the street-facing facade line is not 13 <br />required to comply with the fence height limitatfon for the front setbackof EMC 14 <br />19.40.010(4)(a). 15 <br />e. Conditfonal Uses. For development subject to the conditfonal use process, fences 16 <br />may deviate from the standards in this sectfon as approved by the review authority. 17 <br />f. Corner Sites and Vision Clearance. See EMC 19.41.060(B). 18 <br />B. MU and NB Zones. 19 <br />1. Height and Locatfon. Fences may be up to six feet in height if the fence is at least ten feet 20 <br />from the back of the sidewalk and is at least seventy percent transparent. The transparency 21 <br />requirement shall not apply to any fence thirty-six inches or less in height. If no sidewalk exists, 22 <br />the fence must be set back a minimum of ten feet from where the sidewalk will be placed in the 23 <br />future as determined by the city engineer. 24 <br />2. Materials. Chain link, wire, corrugated, sheet metal or other similar types of fences are 25 <br />prohibited. 26 <br />C. Freeways (I-5 and SR-526). Fences abutting freeways shall have no height limit. 27 <br />D. Commercial Mixed-Use and Industrial Zones. Fences in commercial mixed-use and industrial zones 28 <br />shall not exceed ten feet in height, including barbed wire located on top of the fence except: 29 <br />1. Any fence taller than forty-two inches must be set back a minimum of ten feet or the 30 <br />required landscape width, whichever is greater, from any lot line along a street; and 31 <br />2. Any fence within ten feet of a residentfally zoned property shall not exceed seven feet in 32 <br />height. 33 <br />3. See subsectfon (B) of this sectfon for fence height restrictfons in the MU and NB zones. 34 <br />E. Retaining Walls and Berms. Fences placed on top of berms shall be constructed so as not to exceed 35 <br />the maximum height allowed if the berm were not there. Fences placed upon rockeries or retaining walls 36
