EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 291 <br />shall be permitted to be constructed to the maximum allowable fence height above the rockery or 1 <br />retaining wall, provided the rockery or retaining wall does not exceed a height of six feet. Fences 2 <br />constructed on top of retaining walls which are greater than six feet in height shall not exceed a 3 <br />maximum fence height of forty-two inches. 4 <br />19.40.020 BARBED WIRE, RAZOR WIRE, CHAIN LINK, ELECTRIC AND OTHER SIMILAR FENCE 5 <br />MATERIALS. 6 <br />A. Barbed wire, razor wire and other such materials are not permitted in any residentfal zone except for 7 <br />security facilitfes around utflity or communicatfons facilitfes, or government facilitfes. In commercial and 8 <br />industrial zones, these fencing materials are permitted only atop a fence or wall at least six feet in height. 9 <br />For property located within a commercial or industrial zone, these materials are not permitted on any 10 <br />fence located within ten feet of a residentfally zoned property. 11 <br />B. Wire, excluding chain link, corrugated, nondecoratfve sheet metal, or other similar type fencing is 12 <br />prohibited along a street frontfng lot line in all zones. 13 <br />C. Chain link fences are prohibited in the MU and UR4 zones and UR7 zone, and in the historic overlays. 14 <br />D. Electric Fences. Electric fences may be installed and maintained in the AG zone for the purpose of 15 <br />controlling permitted livestock; provided, that no such fence shall border any public right-of-way or 16 <br />constftute a lot line fence. Electric fences are permitted in mixed-use commercial and industrial zones 17 <br />using the review process described in Chapter 15.02 EMC, provided such fence shall be installed interior 18 <br />to a nonelectric perimeter barrier not less than six feet in height. 19 <br />CHAPTER 19.43 ENVIRONMENTAL POLICY 20 <br />19.43.140 CATEGORICAL EXEMPTIONS—INFILL DEVELOPMENT. 21 <br />The following exempt levels are established for new constructfon under RCW 43.21C.229: 22 <br />A. Residentfal development up to two hundred dwelling units in Metro EverettMixed-Use Centers, 23 <br />urban residentfal 4 (UR4) UR7 zones, or mixed urban (MU) zones; 24 <br />B. Mixed-use development in Metro EverettMixed-Use Centers, or mixed urban (MU) or business (B) 25 <br />zones; 26 <br />C. Commercial development up to sixty-five thousand square feet, excluding retail development; or 27 <br />D. Any minor new constructfon identffied as exempt pursuant to EMC 19.43.130. 28 <br />CHAPTER 19.45 ANNUAL REPORT 29 <br />19.45.010 DIRECTOR OF PLANNING AND COMMUNITY DEVELOPMENT DUTIES. 30 <br />The director of planning and community development shall make an annual report to the city council in 31 <br />January of each year on the status of the zoning code and map implementatfon of the comprehensive 32 <br />plan. 33
