Usage. For purposes of this chapter, unless the context clearly requires otherwise: 3 <br />1. Any official identffied in this chapter includes any designee of or successor to that official. 4 <br />2. “Applicant” refers to the person or entfty proposing a project. “Applicant” includes private or 5 <br />public entftfes. “Applicant” includes the entfty for which an authorized representatfve is 6 <br />submitting an applicatfon. “Applicatfon” includes any project permit applicatfon under Chapter 7 <br />15.01 EMC. 8 <br />3. “Environmental impact” has the same meaning as in SEPA and includes: (a) effects on 9 <br />transportatfon network; (b) physical effects on people using the transportatfon network, such as 10 <br />public health and safety; and (c) effects of traffic or of the locatfon or operatfon of transportatfon 11 <br />facilitfes on people and the environment, such as noise, air quality, and critfcal areas. 12 <br />4. “Fee for transportatfon system improvements” refers to a fair share of regulatory fee that is 13 <br />placed in a dedicated fund and that helps to address and mitfgate a proposed project’s impacts 14 <br />on the transportatfon system, as provided in this chapter, and does not refer to a method to 15 <br />raise revenue for the general fund to pay for transportatfon improvements. 16 <br />5. “Including” means including but not limited to. 17 <br />6. “May” is optfonal and permissive and does not impose a requirement. 18 <br />7. Sectfon and paragraph tftles are not intended to have regulatory effect. 19 <br />8. “Shall” is mandatory. 20 <br />9. Singular includes plural and conversely, unless context clearly requires otherwise. 21 <br />B. Definitions. Terms in this chapter shall have the same meaning as terms defined in: (1) EMC 22 <br />19.43.030 (SEPA definitfons incorporated by reference from Chapter 197-11 WAC) and 19.43.040 23 <br />(additfonal SEPA definitfons); and (2) RCW 82.02.090 (except that, as defined in subsectfon (C) of this 24 <br />sectfon, “project improvements” shall be referred to as “local transportatfon improvements” and 25 <br />“system improvements” shall be referred to as “transportatfon system improvements” and are not 26 <br />limited to facilitfes identffied in the capital facilitfes plan. 27 <br />C. Additional Definitions. In additfon to the definitfons referenced in subsectfon (B) of this sectfon, when 28 <br />used in this chapter, the following terms shall have the following meaning: 29 <br />“Characteristfcs of development” means the specific features of and effects caused by a 30 <br />proposed project, including its compliance with development standards. 31 <br />“Comprehensive plan” means the city of Everett comprehensive plan adopted by the city council 32 <br />and existfng at the tfme of project review. The term “comprehensive plan” includes adopted 33 <br />subarea plans. 34
