EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 25 <br />“Conditfonal use” means a use which, because of its unusual size, infrequent occurrence, special 1 <br />requirements, possible safety hazards, or other possible detrimental effects on surrounding propertfes, 2 <br />may be approved only after a public hearing. 3 <br />“Day, working” means any day on which the city administratfve offices are open for normal business. 4 <br />“Development” means all structures, uses or other alteratfons or modificatfons of the natural landscape 5 <br />occurring above or below ground or water on a partfcular lot. Within the riparian habitat zone or the 6 <br />special flood hazard area, the definitfon of “development” shall also include removal of substantfal 7 <br />natfve vegetatfon, or alteratfon of natural site characteristfcs. 8 <br />“Development permit” means any permit issued by the city to use or develop property that must be 9 <br />issued before initfatfng the use or development. 10 <br />“Disabled person” means a person who is defined as handicapped under the provisions of the federal 11 <br />Fair Housing Act Amendments of 1988. 12 <br />“Drainage facility” means the system of collectfng, conveying and storing surface and stormwater runoff. 13 <br />Drainage facilitfes shall include but not be limited to all surface and stormwater runoff conveyance and 14 <br />containment facilitfes, including streams, pipelines, channels, ditches, wetlands, infiltratfon facilitfes, 15 <br />retentfon/detentfon facilitfes, erosion/sedimentatfon control facilitfes, and other drainage structures and 16 <br />appurtenances, both natural and manmade. 17 <br />“Drive-through, drive-up or drive-in service” means a type of service provided by a business that allows 18 <br />customers to purchase products, food, beverages or services without leaving their cars. 19 <br />“Drive- in window or statfon-up service window” means a window or statfon used for providing service 20 <br />to customers who remain seated in their vehicles to conduct a business transactfon, such as are 21 <br />commonly found at restaurants, financial instftutfons, or other similar businesses. 22 <br />“Electric vehicle” means any vehicle that operates, either partfally or exclusively, on electrical energy 23 <br />from the grid, or an off-board source, that is stored on board for motfve purpose. “Electric vehicle” 24 <br />includes: (1) a battery electric vehicle; (2) a plug-in hybrid electric vehicle; (3) a neighborhood electric 25 <br />vehicle; and (4) a medium-speed electric vehicle. 26 <br />“Electric vehicle charging statfon” means a public or private parking space that is served by battery 27 <br />charging statfon equipment that has as its primary purpose the transfer of electric energy (by conductfve 28 <br />or inductfve means) to a battery or other energy storage device in an electric vehicle. 29 <br />“Electric vehicle charging statfon—restricted” means an electric vehicle charging statfon that is (1) 30 <br />privately owned and restricted access (e.g., single-family home, executfve parking, designated employee 31 <br />parking) or (2) publicly owned and restricted (e.g., fleet parking with no access to the general public). 32 <br />“Erosion” means the process whereby the landform is worn away by the actfon of water, wind, rain, or 33 <br />ice actfvity. 34 <br />“Geologist” means a person who is licensed in the state of Washington under the provisions of Chapter 35 <br />18.220 RCW and Chapter 308-15 WAC, and who has at least one year of practfcal experience in the 36 <br />Pacific Northwest. 37
