EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 26 <br />“Grading” means any excavatfng, filling, or clearing of land or any combinatfon thereof. 1 <br />“Hearing examiner” means the land use hearing examiner for the city. 2 <br />“Historical commission” means the historical commission for the city. 3 <br />“Homeless” means a person who lacks a fixed, regular, and adequate nighttime residence, and who has a 4 <br />primary nighttime residence that is: 5 <br />1. A supervised publicly or privately operated shelter designed to provide temporary living 6 <br />accommodatfons; or 7 <br />2. An instftutfon that provides a temporary residence for mentally ill individuals intended to be 8 <br />instftutfonalized; or 9 <br />3. A public or private place not designed for, or ordinarily used as, a regular sleeping 10 <br />accommodatfon for human beings. 11 <br />“Landscaping” means the plantfng, removal and maintenance of vegetatfon along with the movement 12 <br />and displacement of earth, topsoil, rock, bark and similar substances done in conjunctfon with the 13 <br />plantfng, removal and maintenance of vegetatfon. 14 <br />“Low impact development (LID)” means a stormwater management strategy that emphasizes 15 <br />conservatfon and the use of existfng natural site features integrated with distributed, small-scale 16 <br />stormwater controls to more closely mimic natural hydrologic patterns in developed settings. 17 <br />“Metro Everett” means the regionally designated Mixed-Use Center growth centeridentffied on the 18 <br />zoning map for Snohomish County identffied in Chapter 19.02 of the Everett comprehensive plan. 19 <br />“Minor exterior alteratfon” means development that alters the exterior envelope to a building whose 20 <br />value over a three-year period does not exceed fifty percent of the building’s valuatfon based on the city 21 <br />of Everett’s valuatfon methods. 22 <br />“Municipal Code” means the various laws of the city contained within the Everett Municipal Code. 23 <br />“Natfve vegetatfon” means vegetatfon on a site or plant species which are indigenous to the area in 24 <br />questfon; or if the site has been cleared, species of a size and type that were on the site on the effectfve 25 <br />date of this tftle or reasonably could have been expected to have been found on the site at the tfme it 26 <br />was cleared. 27 <br />“Natural topography” means the elevatfon of a parcel of land prior to any human modificatfon of the 28 <br />topography. 29 <br />“Nonconforming building” means a legally established structure or building, the size, dimensions, or 30 <br />setbacks of which met the applicable Unified Development Code requirements in effect at the tfme the 31 <br />building was constructed, but which fails by reason of adoptfon, revision or amendment of the Unified 32 <br />Development Code to conform to the present requirements of the zone in which it is located. 33 <br />“Nonconforming landscaping” means on-site landscaping, the dimensions, area or locatfon of which met 34 <br />the applicable Unified Development Code requirements in effect at the tfme the use or building was 35
