EVERETT 2044 DEVELOPMENT REGULATIONS 6/17/2025 DEVELOPMENT REGULATIONS Page 26 “Grading” means any excavatfng, filling, or clearing of land or any combinatfon thereof. 1 “Hearing examiner” means the land use hearing examiner for the city. 2 “Historical commission” means the historical commission for the city. 3 “Homeless” means a person who lacks a fixed, regular, and adequate nighttime residence, and who has a 4 primary nighttime residence that is: 5 1. A supervised publicly or privately operated shelter designed to provide temporary living 6 accommodatfons; or 7 2. An instftutfon that provides a temporary residence for mentally ill individuals intended to be 8 instftutfonalized; or 9 3. A public or private place not designed for, or ordinarily used as, a regular sleeping 10 accommodatfon for human beings. 11 “Landscaping” means the plantfng, removal and maintenance of vegetatfon along with the movement 12 and displacement of earth, topsoil, rock, bark and similar substances done in conjunctfon with the 13 plantfng, removal and maintenance of vegetatfon. 14 “Low impact development (LID)” means a stormwater management strategy that emphasizes 15 conservatfon and the use of existfng natural site features integrated with distributed, small-scale 16 stormwater controls to more closely mimic natural hydrologic patterns in developed settings. 17 “Metro Everett” means the regionally designated Mixed-Use Center growth centeridentffied on the 18 zoning map for Snohomish County identffied in Chapter 19.02 of the Everett comprehensive plan. 19 “Minor exterior alteratfon” means development that alters the exterior envelope to a building whose 20 value over a three-year period does not exceed fifty percent of the building’s valuatfon based on the city 21 of Everett’s valuatfon methods. 22 “Municipal Code” means the various laws of the city contained within the Everett Municipal Code. 23 “Natfve vegetatfon” means vegetatfon on a site or plant species which are indigenous to the area in 24 questfon; or if the site has been cleared, species of a size and type that were on the site on the effectfve 25 date of this tftle or reasonably could have been expected to have been found on the site at the tfme it 26 was cleared. 27 “Natural topography” means the elevatfon of a parcel of land prior to any human modificatfon of the 28 topography. 29 “Nonconforming building” means a legally established structure or building, the size, dimensions, or 30 setbacks of which met the applicable Unified Development Code requirements in effect at the tfme the 31 building was constructed, but which fails by reason of adoptfon, revision or amendment of the Unified 32 Development Code to conform to the present requirements of the zone in which it is located. 33 “Nonconforming landscaping” means on-site landscaping, the dimensions, area or locatfon of which met 34 the applicable Unified Development Code requirements in effect at the tfme the use or building was 35
