EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 27 <br />established, but which fails by reason of adoptfon, revision or amendment of the Unified Development 1 <br />Code to conform to the present requirements of the zone in which it is located. 2 <br />“Nonconforming lot” means a legally established lot, the area, dimensions or locatfon of which met the 3 <br />applicable Unified Development Code requirements in effect at the tfme the lot was created, but which 4 <br />fails by reason of such adoptfon, revision or amendment of the Unified Development Code to conform to 5 <br />the present requirements of the zone in which it is located. 6 <br />“Nonconforming parking” means legally established off-street parking for a partfcular use, the quantfty, 7 <br />design, locatfon or constructfon of which met the applicable Unified Development Code requirements in 8 <br />effect at the tfme the use was established, but which fails by reason of adoptfon, revision or amendment 9 <br />of the Unified Development Code to conform to the present requirements of the zone in which it is 10 <br />located. 11 <br />“Nonconforming use” means a legally established use which met the applicable Unified Development 12 <br />Code requirements at the tfme it was established but which fails by reason of adoptfon, revision or 13 <br />amendment of the Unified Development Code to conform to the present requirements of the zone in 14 <br />which it is located. 15 <br />“Off-street parking area” means an area designed and/or used for parking vehicles which is not located 16 <br />in a street or alley right-of-way. 17 <br />“Outdoor storage of bulk materials” means the holding or stockpiling on land of material and/or 18 <br />products in a bulk form or in bulk containers, including but not limited to aggregate, topsoil, powder, 19 <br />grain, stone, bricks, wood chips, metal, building materials, parts, pallets, utflity piping, used materials, 20 <br />and metal. Bulk materials may include products for sale, materials used in manufacturing actfvitfes, 21 <br />inoperable equipment or vehicles, and recycled materials. 22 <br />“Owner” means the holder of fee tftle, a mortgagee, or contract purchaser. 23 <br />“Park” means any property designated, dedicated, or developed by or on behalf of a government entfty 24 <br />for park or open space use, including passive and actfve forms of recreatfon. 25 <br />“Parking space” means a portfon of an off-street parking area, meetfng the city’s design and constructfon 26 <br />standards, having access to a public street or alley. 27 <br />“Planning commission” means the planning commission for the city. 28 <br />“Planning department” means the planning department for the city. 29 <br />“Planning director” means the planning director for the city or his/her authorized representatfve. 30 <br />“Practfcable” means possible or capable of being done. 31 <br />“Principal building” means the primary or predominant building on a lot. 32 <br />“Principal use” means the primary or predominant use of any lot or building. 33 <br />“Public agency” means any agency, politfcal subdivision, or unit of local government of this state 34 <br />including but not limited to municipal corporatfons, special purpose districts, and local service districts; 35
