EVERETT 2044 <br />DEVELOPMENT REGULATIONS <br /> <br />6/17/2025 <br />DEVELOPMENT REGULATIONS <br />Page 28 <br />any agency of the state, the United States, or any Indian tribe recognized as such by the federal 1 <br />government. 2 <br />“Public works director” means the public works department director for the city or his/her authorized 3 <br />representatfve. 4 <br />“Reasonable alternatfve” means an alternatfve that is available and capable of being carried out after 5 <br />taking into consideratfon cost, existfng technology, and logistfcs in light of overall project purposes, and 6 <br />having less impacts to regulated critfcal areas. It may include an area not owned by the applicant which 7 <br />could reasonably have been or be obtained, utflized, expanded, or managed in order to fulfill the basic 8 <br />purpose of the proposed actfvity. 9 <br />“Recreatfonal vehicle” means a vehicle which is (1) built on a single chassis; (2) four hundred square feet 10 <br />or less when measured at the largest horizontal projectfon; (3) designed to be self-propelled or 11 <br />permanently towable by a light duty truck; and (4) designed primarily not for use as a permanent 12 <br />dwelling but as temporary living quarters for recreatfonal, camping, travel, or seasonal use. 13 <br />“Redevelopment” means the process to rebuild, restore or develop an area or property that has 14 <br />previously been developed for a specific use or purpose. 15 <br />“Repair or maintenance” means an actfvity that restores the character, scope, size, and design of a 16 <br />serviceable area, structure, or land use to its previously authorized undamaged conditfon. Actfvitfes that 17 <br />change the character, size, or scope of a project beyond the original design and alter a regulated critfcal 18 <br />area are not included in this definitfon. 19 <br />“Retentfon/detentfon facility” means a type of drainage facility designed either to hold water for a 20 <br />considerable length of tfme and then release it by evaporatfon, plant transpiratfon, and/or infiltratfon 21 <br />into the ground; or to hold runoff for a short period of tfme and then release it to the surface and 22 <br />stormwater management system. 23 <br />“Review authority” means the individual or the board, council or commission with authority to review, 24 <br />make recommendatfons concerning, or approve development permits. 25 <br />“Review process” means the procedure listed in EMC Title 15, Local Project Review Procedures, by which 26 <br />a specific use shall be evaluated before a determinatfon is made concerning the issuance of an approval, 27 <br />a license or permit. 28 <br />“Right-of-way” means the actual property which is publicly dedicated or reserved for street and alley 29 <br />access and for other public purposes such as public utflitfes, bicycle paths, and pedestrian walkways. 30 <br />“Sensitfve land uses” means those land uses which are partfcularly sensitfve to the secondary effects of 31 <br />adult use businesses. Sensitfve land uses include the following: 32 <br />1. Single-family and multfple-family residentfal zones; 33 <br />2. Churches, or other religious facilitfes or instftutfons; 34 <br />3. Public and private schools, training facilitfes and technical schools which have twenty-five 35 <br />percent or more of their students under the age of eighteen; 36 <br />4.
