Petroleum refineries. 2 <br />F. Sanitary landfills. 3 <br />19.95.060, MODIFICATION OF USE REGULATIONS 4 <br />A. Use Regulatfons That May Be Modified. An applicant may propose, and the planning director may 5 <br />allow, deny or conditfon using Review Process II, a modificatfon of the special regulatfons and notes in 6 <br />Tables 5-1 through 5-5 in this chapter. 7 <br />B. Evaluatfon Criteria. 8 <br />1. Any proposal to modify use regulatfons shall not undermine the intent of the standards. The 9 <br />planning director shall not approve a request for modificatfon unless the proposal provides 10 <br />architectural and urban design elements equivalent or superior to what would likely result from 11 <br />compliance with the use regulatfons which are proposed to be modified. 12 <br />2. The planning director shall consider the criteria set forth in EMC 15.03.060 in making a 13 <br />decision. 14 <br />19.05.065, ACCESSORY USES, FACILITIES AND ACTIVITIES 15 <br />A. General. Accessory uses, facilitfes and actfvitfes normally associated with a use listed as a permitted 16 <br />use in a zone are permitted as part of that permitted use on the same lot as the principal structure. The 17 <br />accessory use, facility or actfvity must be clearly secondary to the permitted use. The primary use or 18 <br />actfvity shall be established before or concurrent with the accessory use or actfvity. For home 19 <br />occupatfons as an accessory to a residentfal use, see EMC 19.08.120. 20 <br />B. Authority of the Planning Director. The planning director is specifically authorized to determine if a 21 <br />partfcular accessory use, facility or actfvity is normally associated with a partfcular permitted use and if a 22 <br />partfcular accessory use, facility or actfvity is clearly secondary to the permitted use. 23 <br />C. Exceptfons and Limitatfons. This tftle establishes specific limitatfons and regulatfons for some 24 <br />accessory uses and facilitfes for some uses in some zones. Where applicable, those specific regulatfons 25 <br />supersede the general statement of subsectfon (A) of this sectfon. 26 <br />19.05.067, HOME OCCUPATIONS 27 <br />Home occupatfons are permitted in any residentfal zonedwelling unit provided the home occupatfons 28 <br />comply with EMC 19.08.120.19.13.200 29 <br />19.05.068, TEMPORARY USES 30 <br />A. User Guide. This sectfon establishes a mechanism whereby the city may, on a short-term basis, 31 <br />permit a use to be conducted that would not otherwise be allowed in the zone in which it is located. This 32 <br />sectfon is intended to permit certain inherently temporary uses, such as community festfvals and fresh 33 <br />vegetable stands, that would not be allowed in the zone in which they are proposed, but which, if limited 34 <br />in tfme and strictly controlled, may be in the best interest of the Everett community. 35
