The city will use the review process as 1 <br />described in Chapter 15.02 EMC, Local Project Review Procedures, to review and decide upon an 2 <br />applicatfon for a temporary use permit. 3 <br />C. Applicatfon Informatfon. The applicant shall provide the following informatfon to the planning 4 <br />department: 5 <br />1. A completed applicatfon on the form provided by the planning department, along with all 6 <br />informatfon requested in that form; 7 <br />2. An irrevocable, signed and notarized statement grantfng the city permission to summarily 8 <br />abate the temporary use and all physical evidence of that use if it is not removed by the 9 <br />applicant within the period specified as part of the permit, and agreeing to reimburse the city for 10 <br />any expenses incurred by the city in abatfng the temporary use; and 11 <br />3. Written permission from the owner of the property upon which the temporary use is 12 <br />proposed to be located authorizing the proponent to use the subject property for the stated 13 <br />purposes and tfme period. 14 <br />D. Criteria for Grantfng a Temporary Use Permit. The city may grant a temporary use permit only if it 15 <br />finds that: 16 <br />1. The proposed temporary use will not be materially detrimental to the public welfare, or 17 <br />injurious to the property or improvements in the immediate vicinity; and 18 <br />2. The proposed temporary use is compatfble in terms of locatfon, access, traffic, noise, 19 <br />nuisance, dust control and hours of operatfon with existfng land uses in the immediate vicinity; 20 <br />and 21 <br />3. The proposed temporary use is not otherwise allowable in the zone in which it is proposed. 22 <br />E. Dimensional Requirements and Development and Performance Standards. The city shall establish 23 <br />dimensional requirements and development and performance standards as part of the approval of each 24 <br />temporary use permit. The city will use the nature of the proposed use and character of the surrounding 25 <br />area as guides in establishing these requirements and standards. 26 <br />F. Frequency and Duratfon of Temporary Use. The city may not grant a temporary use permit to the 27 <br />same user for the same use more frequently than once in every three-hundred-sixty-five-day period. The 28 <br />city may only grant a temporary use permit for a specified period of tfme, not to exceed sixty days except 29 <br />as otherwise provided in this sectfon. The temporary use permit shall specify a date by which the use 30 <br />shall be terminated. 31 <br />G. Removal of a Temporary Use. The city shall designate, as part of the temporary use permit, a period 32 <br />following the expiratfon of the permit within which the temporary use must be terminated and all 33 <br />physical evidence of the use must be removed by the applicant. If the temporary use and all physical 34 <br />evidence of the use are not removed within the tfme specified, it will constftute a violatfon of this tftle. 35 <br />Further, the city is authorized to abate the temporary use in accordance with subsectfon (C)(2) of this 36 <br />sectfon. 37 <br />H. Exceptfon to Permit Requirement. 38
