Page 12 of 26 <br />II. unsatisfactory performance that causes a negative operational impact on the City or causes the <br />City to commit additional resources to avoid operational impact; <br />III. dishonesty or belligerent conduct; <br />IV. violation of City rules or policies. <br />Upon such written request, the City and Supplier will decide on a course of action to cure any such <br />problems, provided that there shall be no cure opportunity required for problems involving categories (ii) <br />or (iii) in the preceding sentence. In the event the Supplier does not cure the problem within (7) days from <br />the date of notice, the Supplier must remove such person and must promptly provide a qualified <br />replacement. <br />2.13 BACKGROUND CHECKS REQUIRED FOR ACCESS TO POLICE LOCATIONS <br />Prior to accessing either police facility, vending delivery employees and any other employees of the <br />supplier that need un-escorted access to the facilities will be required to be fingerprinted by the Everett <br />police department records division. Fingerprinting will be completed at the Contractor’s expense for a fee <br />of around $15 per person. Those needing unescorted access must complete security awareness training <br />and testing and pass a background check before the award is made and anytime there are personnel <br />changes. Failure to submit to or pass this background check may result in the supplier being considered <br />"non-responsive." The awareness training can be conducted online, and police Records will need each <br />assigned onsite employee's email address to send them a link after they have been fingerprinted. After <br />the award, contractor employees who have passed the background check will be issued a city <br />identification badge. City identification must not be shared among other employees. Failure to adhere to <br />this may result in contract default. All city-issued badges will be returned to the city’s project manager at <br />the end of the contract or an employee’s tenure, whichever comes first. <br />The City of Everett Police Department has sole discretion over whether to grant or deny access to these <br />areas based on security issues. <br />2.14 SUPPLIER RESPONSIBILITIES <br />The awarded Supplier will be responsible for the following: <br />1. Providing, managing, and supervising all supplier personnel associated with the contract. <br />2. Providing reports detailing gross sales receipts and commission earned based on location. <br />3. Providing an easy and efficient process for refunding money lost due to equipment malfunctions <br />without utilizing City of Everett staff resources. <br />4. Clearly posting product pricing. Prices must be clearly seen on each machine or kiosk. <br />5. Displaying and providing nutritional information before purchase. <br />6. Clearly posting company contact information to call or e-mail when a machine malfunctions. <br />7. Securing, maintaining in full force, and displaying, when applicable, all licenses required by the City of <br />Everett, Snohomish County Health Department, and other applicable authorities to operate micro <br />market vending machines and any costs for such licensing. <br />8. All shrinkage, freight, and product handling. <br />9. Paying all sales tax for products sold in the vending machines at the Supplier’s expense.
