City of Everett 00 21 13 - 7 <br />Port Gardner Storage Facility - Facility Construction Package WO# UP-3525 <br /> <br /> <br />00 21 13 - 7 INSTRUCTIONS TO BIDDERS <br />Bidders are warned against making erasures or alterations of any kind to the Bid Form, <br />and bids that contain omissions, erasures, or irregularities of any kind may be rejected. <br />No oral, telegraphic, electronic, or telephonic bids or modifications will be considered. <br />In the event that the product of a unit price and an estimated quantity does not equal the <br />extended amount quoted, the unit price shall govern, and the correct product of the unit <br />price and the estimated quantity shall be deemed to be the amount bid. If the sum of two <br />or more items in a bidding schedule does not equal the total amounts quoted, the individual <br />item amounts shall govern and the correct total shall be deemed to be the amount bid. <br />RCW 35.22.650 CERTIFICATION <br />Contractor agrees that the Contractor shall actively solicit the employment of minority <br />group members. Contractor further agrees that the Contractor shall actively solicit Bids <br />for the subcontracting of goods or services from qualified minority businesses. Contractor <br />shall furnish evidence of the Contractor's compliance with these requirements of minority <br />employment and solicitation. Contractor further agrees to consider the grant of <br />subcontracts to said minority bidders on the basis of substantially equal proposals in the <br />light most favorable to said minority businesses. The Contractor is required to submit <br />evidence of compliance with this section as part of the Bid by completing and submitting <br />with the Bid the RCW 35.22.650 CERTIFICATION. <br />PROPOSED SUBCONTRACTORS FORM <br />Bidder shall complete SECTION 00 4336 – PROPOSED SUBCONTRACTORS FORM <br />and submit it with the Bid. <br /> <br />NONCOLLUSION AFFIDAVIT <br />The City has determined every Bidder must submit a Non-Collusion Affidavit for every <br />Project. Accordingly, the Bidder shall submit a “Non-Collusion Affidavit”, contained in the <br />Contract Documents as SECTION 4519 NONCOLLUSION AFFIDAVIT, with the Bid. If <br />the City has reason to believe that collusion exists among Bidders, the City will reject the <br />Bids of the known participants in such collusion and may, at its option, require that all <br />Bidders certify under penalty of perjury, that no collusion has occurred or exists. <br /> <br />1-02.7 Bid Security <br />Bid Security in the amount of at least 5 percent of the Total Base Bid shall accompany <br />each Bid. This security may be by certified check, cashier’s check, or a bid bond made <br />payable to the City of Everett. A bid bond shall be on the form provided in the Contract <br />Documents. A bid bond shall not be conditioned to modify the minimum 5-percent <br />required. The surety shall: (1) be registered with the Washington State Insurance <br />Commissioner, and (2) appear on the current Authorized Insurance List in the State of <br />Washington published by the Office of the Insurance Commissioner. <br />The failure to furnish a bid security of a minimum of 5 percent shall make the Bid <br />nonresponsive and shall cause the Bid to be rejected by the City of Everett.
