CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 2 Div 1 – GEN REQUIREMENTS October 2025 <br />Work Order No. UP 3814 SP-56 <br />Category 2: Sensitive information <br />Category 2: For official use only / disclosure permissible by law. <br />1-03.6 Return of Bid Deposit <br />Supplement 1-03.6 by adding the following: <br />Within 15 calendar days after the Bids are opened, the City will return the bid deposit <br />accompanying the Bids that are not to be considered in making the Award. <br />1-03.7 Judicial Review <br />Revise 1-03.7 to read as follows: <br />All protests by Bidders must be in accordance with Chapter 3.46 of the Everett Municipal <br />Code, “Bid Protest Procedures.” <br />The exclusive venue of all lawsuits shall be in Snohomish County Superior Court. <br /> <br />1-04 SCOPE OF THE WORK <br />1-04.1 Intent of the Contract <br />Supplement 1-04.1 by adding the following: <br />1-04.1(3) Specifications and Plans <br />(******) <br />1-04.1(3)A Interpretation of Specifications and Plans <br />The Specifications and Plans are intended to be explanatory and supportive of each <br />other. Work specified on the Plans and not in the Specifications, or vice versa, shall <br />be executed as if specified in both. In the event the Work to be done or matters <br />relative thereto are not sufficiently detailed or explained in the Contract Documents, <br />the Contractor shall immediately ask the City’s Representative for further <br />explanation and shall comply with such explanation. In the event of doubt or <br />question arising respecting the true meaning of the Specifications or Plans, <br />Contractor shall refer to the City’s Representative for its decision. <br />1-04.1(3)B Division of Specifications and Plans <br />Specifications and Plans are divided into groups for convenience. These divisions <br />are not for the purpose of apportioning Work or responsibility for Work among <br />Subcontractors, Suppliers, and manufacturers. The Contractor is responsible for all <br />Work shown or described, regardless of location(s) in the Contract Documents. <br />1-04.1(3)C Discrepancies in Specifications and Plans <br />1-04.1(3)C(1) Errors and Omissions <br />If the Contractor becomes aware of any errors or omissions in the Contract <br />Documents or in the City's field work, it shall immediately inform the City’s <br />Representative in writing. The City’s Representative will promptly review the <br />matter and if it finds an error or omission has been made; it will determine the <br />corrective actions and advise the Contractor accordingly. If the corrective work <br />associated with an error or omission increases or decreases the amount of <br />Work called for in the Contract, the City will issue an appropriate Change Order. <br />After discovery by the Contractor of an error or omission, related Work <br />performed by the Contractor shall be done at its risk unless authorized by the <br />City’s Representative and approved by the City. <br />1-04.1(3)C(2) Conflicting Provisions <br />In the event an item of Work is described differently in two or more locations on <br />the Plans, in the Specifications and Special Provisions, the Contractor shall, <br />upon request of the City’s Representative, submit in writing to the City’s
