CITY OF EVERETT SPECIAL PROVISIONS <br /> <br />Water Main Replacement “Y” – Ph 2 Div 1 – GEN REQUIREMENTS October 2025 <br />Work Order No. UP 3814 SP-77 <br />Category 2: Sensitive information <br />Category 2: For official use only / disclosure permissible by law. <br />1-05.18(3)H Safety Standards <br />The Contractor shall comply with Section 107 of the Contract Work Hours and <br />Safety Standards Act (40 U.S.C. 327-330) as supplemented by Department of <br />Labor Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not <br />require any laborer or mechanic to work in surroundings or under working conditions <br />that are unsanitary, hazardous, or dangerous to its health and safety as determined <br />under construction, safety, and health standards promulgated by the Secretary of <br />Labor. These requirements do not apply to the purchase of supplies or materials or <br />articles ordinarily available on the open market, or contracts for transportation or <br />transmission of intelligence. <br />1-05.18(3)I Public Safety and Convenience <br />The Contractor shall conduct its work so as to ensure the least possible obstruction <br />to traffic and inconvenience to the general public, business, organizations and <br />residents in the vicinity of the Work and to reasonably protect persons and property. <br />No roads or street shall be closed to the public except with the permission of the <br />City's Representative and the proper governmental authority. Fire hydrants on or <br />adjacent to the Work shall be accessible to firefighting equipment. Temporary <br />provisions shall be made by the Contractor for the use of sidewalks, private and <br />public driveways and proper functioning of gutters, sewer inlets, drainage ditches <br />and culverts, irrigation ditches and natural water courses. <br />1-05.19 City-Contractor Coordination <br />(******) <br />1-05.19(1) Suggestions to Contractor <br />Nothing in these Contract Documents requires the City’s Representative to provide the <br />Contractor with direction or advice on how to do the Work, construction practices, or <br />means and methods. If the City’s Representative approves, suggests or recommends <br />any construction practice, means, method or manner for doing the Work or producing <br />materials, the approval or recommendation shall not: (A) guarantee that following the <br />method or manner will result in compliance with the Contract Documents; (B) relieve the <br />Contractor of any risks or obligations under the Contract Documents; or (C) create <br />liability by the City to the Contractor. <br />Suggestions as to the plans or methods of accomplishing the Work or Contract <br />requirements by the City or the City’s Representative to the Contractor but not specified <br />or required, if adopted or followed by the Contractor in whole or in part, shall be used at <br />the risk and responsibility of the Contractor. The City and the City’s Representative <br />assume no responsibility therefore and in no way will be held liable for any defects in <br />the Work which may result from or be caused by use of such plan or method of Work. <br />1-05.19(2) Meetings with City <br />The Contractor shall have its duly authorized representative attend periodic <br />informational meetings with the City’s Representative and City staff, as reasonably <br />required by the City. <br />Contractor, City, and City’s Representative shall meet as often as determined by the <br />City’s Representative, but no less often than once each month. The purpose of the <br />meeting is to review Project status in relation to the construction schedule; review value <br />of Work completed during the previous month; and, if applicable, review Contractor's <br />plans to return Project status to that required by the schedule. If requested by the City <br />or City’s Representative, the Contractor shall submit a written progress report within five <br />days following this meeting, comprising:
