agreement in writing containing a legal description of said premises, <br /> signed and acknowledged by such owner, for himself and for his heirs , <br /> executors, administrators and assigns , to save and protect the city <br /> of Everett free and harmless from all claims, actions or damages of <br /> every kind and description which may accrue to or be suffered by <br /> any person by reason of the construction, existence, maintenance, or <br /> use of any oil tank beneath such public place, and an agreement that <br /> the permit therefor is wholly of a temporary nature and shall vest <br /> no permanent rights whatsoever but is subject to revocation by the <br /> city council , as in such permit provided, and shall pay a fee of <br /> two and fifty hundredths dollars for one lot or fraction thereof, <br /> to cover the cost of recording abstract and inspection of the same. <br /> Section 4. PERMIT TO LESSEE ; BONDS REQUIRED: A permit <br /> for the construction and maintenance of fuel oil tanks beneath public <br /> places may be granted upon the filing of a proper bond in an amount <br /> to be determined by the city council, by the lessee of the premises <br /> in front of and in connection with which the same is to be constructed, <br /> maintained, used, operated, or made when such lessee shall have <br /> executed and delivered to the city clerk a good and sufficient bond <br /> containing an agreement in writing, signed and acknowledged by <br /> the bonding company' s proper officers, and containing a legal des- <br /> cription of said premises and a covenant on the part of such bonding <br /> company to save and protect the city of Everett free and harmless <br /> from all claims, actions or damages of every kind and description <br /> to <br /> which may accrueAor be suffered by any person by reason of the <br /> construction, existence, maintenance or use of such fuel oil tank <br /> beneath such public place, and subject to revocation as in such <br /> permit provided. <br /> Section 5.
