•r t <br /> WHEREAS, pursuant to Articles IV and V of the Charter of the City of Everett, <br /> the Mayor shall nominate board appointees subject to Council approval; <br /> WHEREAS, under RCW 35.57.010, once a public facilities district is created by <br /> adoption of an ordinance providing for the creation of such district by the legislative <br /> authority of the city in which the proposed distinct is located, the district shall be <br /> governed by a Board of Directors consisting of five (5) members; and <br /> WHEREAS, as authorized by the Act and subject to certain restrictions, a public <br /> facilities district may impose a 0.033 percent(0.033 of 1%) sales and use tax that is <br /> deducted from the amount of the sales and use tax otherwise required to be collected and <br /> paid over to the Washington state department of revenue under Chapter 82.08 and 82.12 <br /> RCW, RCW 82.14.048 and RCW 82.14.390; and <br /> WHEREAS, as authorized by RCW 35.57.100, a public facilities district may <br /> levy and fix a tax of not more than one cent($0.01) on twenty cents ($0.20) or fraction <br /> thereof to be paid by the persons who pays an admission charge to a regional center, and <br /> may levy and fix a tax on any vehicle parking charges imposed at any parking facility <br /> that is owned or leased by the public facilities district as part of the regional center; and <br /> WHEREAS, the City Council desires to set forth certain principles relating to the <br /> Everett Public Facilities District and its Board; and <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section A. Pursuant to the Act, the City hereby authorizes and approves the <br /> creation of a public facilities district, to be known as the Everett Public Facilities District, <br /> (the"District") co-extensive with the boundaries of the City of Everett, now established <br /> or as may be reconfigured, with all the powers and authority set forth in the provisions of <br /> the Act, including any amendments thereto, and including the authority to acquire, <br /> design, construct, own, finance, and operate a regional center. The Mayor, the City Clerk <br /> and other appropriate officers of the City are hereby authorized and directed to take any <br /> and all such additional actions as may be necessary or desirable to accomplish the <br /> creation of the District. <br /> Section B. The Board of Directors of the District(the"Board) shall hereafter be <br /> nominated by the Mayor, as required by Articles IV and V of the City Charter, and <br /> approved by the Council, as required by the Act.
