Severe offenses include but are not limited <br />to the following: <br /> <br />1A - Conducts tests outside of authority, while suspended, or expired. <br />Examples • (CDL) Conducts skills test on vehicle type not authorized. <br />• Conducts test while in suspension status. <br />• Unlicensed Practice <br />First Offense • Immediate stop service until DOL can complete an investigation. <br />• Reimburse as applicable and provide proof to DOL <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />Second Offense • Immediate stop service. <br />• Reimburse as applicable and provide proof to DOL. <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />• Contract cancellation. <br /> <br />1B - Conducts tests on an unauthorized route. <br />Examples • Conducts test on unauthorized route. <br />First Offense • Immediate stop service until DOL can complete an investigation. <br />• Reimburse as applicable and provide proof to DOL <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />Second Offense • Immediate stop service. <br />• Reimburse as applicable and provide proof to DOL. <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />• Contract cancellation. <br /> <br />1C - Denying access to DOL or other state or federal partners for the purpose of conducting <br />scheduled or unscheduled examinations, inspections, training, or audits. <br />Examples • Refuses entrance to auditor. <br />• Ceases testing upon DOL or FMCSA arrival. <br />• Refuses entry but continues testing. <br />• Fails to attend required in-service and/or supplemental training. <br />First Offense • Immediate stop service until DOL can complete an investigation. <br />• Reimburse as applicable and provide proof to DOL <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />Second Offense • Immediate stop service. <br />• Reimburse as applicable and provide proof to DOL. <br />• Invalidate Driver(s) test or segment of test as applicable. <br />• Customer may be required to retest with DOL. <br />• Contract cancellation. <br />Docusign Envelope ID: 4798BD77-1E90-44A1-9098-432C0EDF7393
