structure(s)Unlawful as defined by the International Property Maintenance Code(IPMC) in violation of

<br /> • !RC 105.1 Required.
<br /> Any owneror authorized agentwho intends to construct,enlarge,alter,repair, move,demolish
<br /> or change the occupancy of a building or structure,or to erect,install,enlarge,alter,repair,
<br /> remove,convert or replace any electrical,gas, mechanical or plumbing system,the installation
<br /> of which is regulated by this code,or to cause any such work to be done,shall first make
<br /> application to the building official and obtain the required permit.
<br /> IPMC 111.1.4 Unlawful structure.
<br /> An unlawful structure is one found in whole or in part to be occupied by more persons than
<br /> permitted under this code,or was erected,altered or occupied contrary to law.
<br /> IPMC 109.1 Unlawful acts.
<br /> It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any
<br /> of the provisions of this code.
<br /> The alterations to the ROW easement,and creation of new driveway surface, without a Public Works
<br /> Permit and approvals are violations of the Everett Municipal Code(EMC) 13. 16.020 A,and EMC 13.76,
<br /> which adopts the Design and Construction Standards and Specifications for Development—as written
<br /> within that document,Volume I,Section 1-7:Permits
<br /> which reads:
<br /> • EMC 13.16.020 Improvement permit required
<br /> A. No person,firm or corporation shall remove,alter or construct any curb,sidewalk,driveway
<br /> approach,gutter,pavement or other improvement in any public street,alley or other property
<br /> owned by or dedicated to or used by the city and over which it has jurisdiction to regulate the
<br /> matters covered hereby,without first obtaining a permit from the city engineer,and no permit
<br /> shall be granted until the applicant shall file with the city engineer for his approval a copy of a
<br /> drawing showingthe location and size of all such proposed improvements to serve the property
<br /> affected.

<br /> EMC 13.76.010 Development and dissemination.
<br /> The mayor and/or the director of public works is hereby authorized to develop,disseminate,
<br /> revise and update design and construction standards and specifications for utility work,work in
<br /> the public right-of-way or in easements,and all other work performed pursuant to construction-
<br /> related permits issued by the city of Everett. (Ord.898-82§ 1, 1982.)

<br /> 1-7 PERMITS A permit is required for all work within the public right-of-way and city utility
<br /> easements,and for all work on private property,including but not limited to;sewer,water,and
<br /> drainage improvements,fill and excavation, parking lot construction, retaining walls and/or
<br /> paving.Consult with City of Everett Permit Service for the appropriate type of permit and its
<br /> required documents.
